Title: a. RECOMMENDATION:

It is recommended that the Board of Supervisors:

a. Approve and authorize the Director or Assistant Director of the Department of Social Services to sign an agreement with the Industrial Employers and Distributors Association (IEDA) for $67,764 to represent the County in labor negotiations with the In-Home Supportive Services (IHSS) care providers union (SEIU 2015) for the period of July 1, 2022, to June 30, 2025, including non-standard indemnification terms; and

b. Authorize the Director of the Department or Assistant Director of Social Services to sign up to three (3) amendments to this agreement as long as they do not exceed 10% ($6,776) of the contract amount or significantly change the scope of services.

 

SUMMARY/DISCUSSION:

IEDA has provided labor negotiation services for Monterey County’s In-Home Supportive Services program for over twenty years. Their services include meeting and conferring with representatives of the provider labor organization, negotiating Memorandum of Understanding (MOU) language on behalf of Monterey County, and consulting directly with the Monterey County Board of Supervisors as necessary.

 

The Department recommends approval of the contract with the non-standard indemnification language due to limited alternative resources for these services, the desire to preserve an ongoing positive relationship with the current provider, and the need for uninterrupted service.

 

OTHER AGENCY INVOLVEMENT:

The Auditor Controller and Purchasing have reviewed and approved this Agreement. County Counsel has approved the Agreement as to form. Risk Management has approved the nonstandard indemnification terms.

 

FINANCING:

This agreement is funded with federal and state revenues. Sufficient appropriations and estimated revenues in Fund 005-SOC008 are included in the FY 2022-23 Requested Budget. Future year funding will be incorporated into the corresponding budget process.

This contract correlates to the Administration Strategic Initiative adopted by the Board of Supervisors by streamlining the IHSS provider labor negotiation process to reach an efficient and effective labor agreement.
