RECOMMENDATION:
It is recommended that the Board of Supervisors receive a report on Public Safety Realignment prepared by the Probation Department for the period covering 10/01/11 through 06/30/14.
SUMMARY:
As lead agency and fiscal agency for the implementation of AB 109 - Public Safety Realignment, the Monterey County Probation Department has prepared an informational report on realignment for the three fiscal years since implementation: October 1, 2011 through June 30, 2012; July 1, 2012 through June 30, 2013; and July 1, 2013 through June 30, 2014.
DISCUSSION:
Effective October 1, 2011, the Public Safety Realignment law represented one of the most significant changes to California corrections and public safety in decades, with significant legislative changes and increases in local authorities' span of control for custody and supervision.
The law realigned numerous responsibilities concerning adult felony offenders to the County, specifically: 1) local custody for non-violent, non-serious, non-sex offenders who are no longer eligible for commitment to state prison; 2) local supervision (Post-Release Community Supervision - PRCS) for parolees convicted of non-serious offenses now under the responsibility of the Probation Department; and 3) local custody up to 6 months for parole violations, with some exceptions.
Further, it created "Mandatory Supervision", which gave the Superior Court the additional option of "splitting" the local prison sentence, thereby dividing the time of a sentence between a jail term and a period of supervision by a probation officer.
This Report provides information about crime and arrests; distribution of funding among the three major categories of treatment and intervention, supervision, and custody; number of straight sentences of incarceration and mandatory supervision sentences; alternatives to custody; evidence-based practices, tools and services; and upcoming data collection efforts. It is intended to provide the Board, and the public, with a sense of how realignment has functioned so far.
Data sources for the report include the Probation Department, Monterey County Jail, District Attorney and community service providers.
OTHER AGENCY INVOLVEMENT:
The report was presented and received by the Community Corrections Partnership (CCP) at its meeting of December 8, 2014.
FINANCING:
There is no additional cost to the County General Fund with the recommended action.
