RECOMMENDATION:

It is recommended that the Board of Supervisors:

a. Ratify the execution by the Director of Health Services, of Amendment No. 1 to the Agreement with Arbor Environmental, LLC., (“Arbor”) for professional consulting services related to qualitative respirator fit testing, modifying the automobile insurance provisions, with no change to term October 10, 2022 to October 9, 2024 or Agreement amount of $32,500; and

b. Approve the recommendation of Director of Health Services to accept non-standard provisions related to automobile insurance in Amendment No. 1.


SUMMARY/DISCUSSION:

The County of Monterey Health Department Clinic Services Bureau (“Clinic Services”) operates ten community clinic sites designated as Federally Qualified Health Centers (FQHCs) which provide preventive, primary, and specialty medical care services.

On October 7, 2022, Clinic Services entered into an agreement with Arbor Environmental, LLC (“Arbor”) for the term October 10, 2022 to October 9, 2024, in the amount of $32,500. The agreement provides professional consulting services related to qualitative respirator fit testing (fit testing).

California Title 22 and the Occupational Safety and Health Administration (OSHA) require all clinic staff complete fit testing annually. Fit testing was last conducted in December 2022 and Clinic Services staff are due to complete fit testing in December 2023 to maintain Title 22 and OSHA compliance.

Arbor has requested waiver of the automobile liability requirements for remainder of term of agreement.  For the December 2023 fit testing, Arbor will send technicians to the County of Monterey via airplane and Uber/Lyft rides rather than using company or personal vehicles.


Approval of the Board of Supervisors was delayed due to negotiations of non-standard contract terms and Clinic Services requested execution of the Amendment by the Director of Health Services, to avoid delayed fit testing which would jeopardize Clinic Services’ Title 22 and OSHA compliance.

This work supports the Monterey County Health Department 2018-2024 Strategic Plan Initiatives: 4.) Engage MCHD workforce and improve operational functions to meet current and developing population health needs.  It also supports one or more of the ten essential public health services, specifically: 6.) enforce laws and regulations that protect health and ensure public safety; and 8.) assure competent public and personal health care workforce.

OTHER AGENCY INVOLVMENT:
County Counsel has reviewed as to legal form. Auditor-Controller has reviewed as to fiscal provisions.

FINANCING:
Sufficient appropriations are available in the FY 2023-2024 Adopted Budget for Clinic Services Bureau, Health Department (4000-HEA007) and there is no financial impact to the General Fund resulting from approval of this Amendment No. 1.
