a. Approve and authorize the Assistant County Administrative Officer to sign an Agreement between the County of Monterey and the Peace Officers Association of the County of Monterey dba Monterey County Peace Officers Association to operate and maintain the Law Enforcement Firearm Range, buildings and grounds at Laguna Seca Recreation Area with the initial Agreement term retroactive to January 1, 2020 through December 31, 2029; and
b. Authorize the Assistant County Administrative Officer to sign up to three (3) Amendments to the Agreement where the Amendments do not significantly change the scope of work.

RECOMMENDATION:
It is recommended that the Board of Supervisors:
a. Approve and authorize the Assistant County Administrative Officer to sign an Agreement between the County of Monterey and the Peace Officers Association of the County of Monterey dba Monterey County Peace Officers Association to operate and maintain the Law Enforcement Firearm Range, buildings and grounds at Laguna Seca Recreation Area with the initial Agreement term retroactive to January 1, 2020 through December 31, 2029; and
b. Authorize the Assistant County Administrative Officer to sign up to three (3) Amendments to the Agreement where the Amendments do not significantly change the scope of work.
SUMMARY/DISCUSSION:
Resolution 77-86 authorized the Peace Officers Association to “establish, and thereafter operate and maintain, the Law Enforcement Firearm Range and building on such portion of said Laguna Seca Recreation Area as may be designated by the County’s Director of Parks.” The permit expired on December 31, 1980, and was automatically renewed on an annual basis per the resolution.
On November 19, 2019, the Board of Supervisors approved general consent item No. 19-0866 to approve and authorize the County Administrative Officer to send a notice of non-renewal, effective December 31, 2019, of the Permit for Law Enforcement Firearm Range at Laguna Seca Recreation Area, authorized by Resolution 77-86.
The Monterey County Standard Agreement between the County of Monterey and the Peace Officers Association of the County of Monterey DBA Monterey County Peace Officers Association (MCPOA) to operate and maintain the Law Enforcement Firearm Range, buildings and grounds at Laguna Seca Recreation Area with the initial Agreement term retroactive to January 1, 2020 through December 31, 2029 was discussed and agreed upon with the MCPOA and the Sheriff’s Office. The new agreement will allow for range use by the Sheriff’s Office, the Probation Department and the District Attorney’s Office.
OTHER AGENCY INVOLVEMENT:
The Office of County Counsel has reviewed and approved the Agreement as to form.
FINANCING:
There is no change in financial responsibility by this action.
