Approve and Authorize the Contracts and Purchasing Officer or their designee to execute Amendment 1 to the non-standard Agreement A-16928 with Magnet Forensics, for software subscription and license, effective July 1, 2025 through June 30, 2026, in the amount of $34,760 for a total not to exceed amount of $67,865; and
b. Approve and Authorize the Contracts and Purchasing Officer or their designee to execute three (3) one (1) year amendments where the cost of each amendment does not increase by more than 10% (Amendment #2 - $38,236, Amendment #3 - $42,060, Amendment #4 - $46,266) for a total not to exceed amount of $194,427.

RECOMMENDATION:
It is recommended that the Board of Supervisors:
a. Approve and Authorize the Contracts and Purchasing Officer or their designee to execute Amendment 1 to the non-standard Agreement A-16928 with Magnet Forensics, for software subscription and license, effective July 1, 2025 through June 30, 2026, in the amount of $34,760 for a total not to exceed amount of $67,865; and
b. Approve and Authorize the Contracts and Purchasing Officer or their designee to execute three (3) one (1) year amendments where the cost of each amendment does not increase by more than 10% (Amendment #2 - $38,236, Amendment #3 - $42,060, Amendment #4 - $46,266) for a total not to exceed amount of $194,427.
SUMMARY/DISCUSSION:
The Board of Supervisors approved the Non-standard Agreement A-16928 with Magnet Forensics on June 25, 2024. The Monterey County Sheriff’s Office (MCSO) is requesting approval of this amendment to the non-standard agreement.
Magnetic Forensics GrayKey Software is digital intelligence software which has the only agnostic tool for analysis of data extractions. GrayKey is used by local, state, and federal police agencies for extracting data from both Apple (iOS) and Android devices and only offered to Law Enforcement Agencies or Public Safety entities.
The Magnetic Forensic GrayKey Software supports iOS and Android operating systems and keeps current with updates to ensure unlocking capabilities. The Software is capable of unlocking iOS 17’s Secrets and exploiting the full file system.
Having the ability to extract data from current iOS and Apple devices provides investigations the ability to analyze data for crime investigations and public safety. The software has the ability to access credentials like Keychain and Key store to decrypt content.
The software allows to retrieve deleted data and uncover more pictures videos, encrypted messaging and iOS chats, chat histories, location data and internet evidence than any other solution provider.
The information can be used in criminal and civil trials and respond to questions or complaints from the community.
OTHER AGENCY INVOLVEMENT:
The Office of County Counsel has reviewed and advised on this Agreement as to legal form. The Auditor-Controller’s Office reviewed the contract, but does not agree to the non-standard payment provisions. District Attorney, Public Defenders Office and Information Technology Department support this agreement.
FINANCING:
The costs of this contract is included in the FY 2025-26 Requested Budget, and ongoing costs will be included in future year budgets. There will be no increase in the General Fund Contribution resulting from this Board action.
