(a California Professional Corp (contractor), and the Participating Assessors’ (“Participating Assessors”) in Counties containing oil, gas and geothermal energy-producing properties, for a Petroleum & Geothermal Property Sales Study, retroactive to November 1, 2018 through and including October 31, 2020; and
b. Accept and acknowledge the non-standard terms of the Agreement; whereas the terms of the Agreement provide greater protection to the County than the standard terms; therefore, the Agreement is not detrimental to Monterey County.

RECOMMENDATIONS:
It is recommended that the Board of Supervisors:
a. Approve and authorize the Assessor to enter into a renewed two (2) year agreement with the California Assessors’ Association (a non-profit assoc.), Harold W. Bertholf, Inc. (a California Professional Corp (contractor)), and the Participating Assessors’ (“Participating Assessors”) in Counties containing oil, gas and geothermal energy-producing properties, for a Petroleum & Geothermal Property Sales Study, retroactive to November 1, 2018 through and including October 31, 2020; and
b. Accept and acknowledge the non-standard terms of the Agreement; whereas the terms of the Agreement provide greater protection to the County than the standard terms; therefore, the Agreement is not detrimental to Monterey County.
SUMMARY/DISCUSSION:
Monterey County has entered into an agreement with the California Assessors’ Association and Harold W. Bertholf, Inc. The California Assessors’ Association is composed of all California County Assessors. The Assessors of Contra Costa, Fresno, Humboldt, Kern, Kings, Los Angeles, Madera, Monterey, Orange, Sacramento, San Luis Obispo, Santa Barbara, Sutter, Ventura and Yolo Counties are members of the California Assessors’ Association and together comprise the “Participating Assessors”. They have agreed to enter into this agreement with the California Assessors’ Association and Harold W. Bertholf, Inc. to gather, coordinate and analyze sales and property information data from oil, gas and geothermal energy-producing property sales within each of their respective Counties to share the information and analysis among themselves for purposes of property tax appraisals.
The California Assessors’ Association serves as the coordinator to gather and analyze relevant property valuation information and coordinate the exchange of such information among the “Participating Assessors”. The members of the “Participating Assessors’” have agreed to enter into the Agreement with the California Assessors’ Association and Contractor.
Contractor shall assist the “Participating Assessors’” in gathering and compiling information concerning the fair market value of oil, gas and geothermal energy-producing properties as evidenced by the purchases and sales of such properties. Contractor will coordinate and perform an analysis of the sales information compiled; prepare, distribute and explain a Sales Survey Report detailing the results of the sales study survey. Contractor shall provide monthly statements to the California Assessors’ Association for services rendered during the term of this Agreement.
California Assessors’ Association shall allocate the respective share of the annual costs of this Agreement to be paid among the “Participating Assessors” as follows:

Because this Agreement is entered into as part of a Joint Powers Agreement with other California Counties, the Assessor must obtain approval from the Board of Supervisors to execute this Agreement. Monterey County has successfully participated in this coordination and cooperation through a similar, if not identical agreement for over 10 years, and this Agreement is effectively the renewal of this profitable service.
OTHER AGENCY INVOLVEMENT:
The Office of the County Counsel has reviewed and approved the agreement as to form and legality.
FINANCING:
The annual cost to the Monterey County Assessor’s Office for the two (2) year term of November 1, 2018 through October 31, 2020 is $990 per year. There is no impact to the General Fund, as the Agreement cost is within the Assessor’s 2018-2019 Adopted Budget (1180-ACR001-8003) for the recommended action. Transactions relating to future fiscal years will be included in each respective recommended budget.
