b.  Authorize the Chairperson of the Board of Supervisors and the Chairperson of the Monterey County Workforce Development Board to sign the application

RECOMMENDATION:

It is recommended that the Board of Supervisors:

a.                     Approve the submission of the unsigned application for Local Board Recertification under the Workforce Innovation and Opportunity Act, (Public Law 113-128) Sections 106 and 107, to the State of California Employment Development Department; and

b.                     Authorize the Chairperson of the Board of Supervisors and the Chairperson of the Monterey County Workforce Development Board to sign the application

 

SUMMARY:

In accordance with Section 106 and 107 of the Workforce Innovation and Opportunity Act of 2014 (WIOA), the Monterey County Workforce Development Board seeks to apply for Existing Local Area Designation and Local Board Re-Certification under the WIOA. Continued receipt of WIOA funds is conditioned upon continuing certification as a Local Area Workforce Development Board. 

 

DISCUSSION:

The State of California Employment Development Department (EDD) issued a final Directive on January 22, 2016 with policies and procedures regarding the Local Board recertification under the new Workforce Innovation and Opportunity Act of 2014.  The directive contains state-imposed requirements, as well as federal requirements, which are indicated by bold, italic type (directive attached).

 

The policy provides guidance and establishes the procedures for recertification of Local Workforce Development Boards (Local Boards) under WIOA.  If granted by EDD, Local Board recertification is effective July 1, 2016 through June 30, 2018.

 

WIOA Sections 106 and 107 provide the criteria for the initial designation of local areas and initial certification of local boards.  Under WIOA Section 106, the Governor shall approve a request made for initial designation by any local area if, during Program Years (PY’s) 2013-14 and 2014-15, the local area:

 

 

 

(1)                     The Local Board met the membership provisions in the WIOA Section 107(b);

(2)                     The Local Board must have achieved 80 percent or higher on at least eight of the nine locally negotiated common performance measures for PYs 2013-14 and 2014-15;

(3)                     The Local Board achieved sustained fiscal integrity; and

(4)                     The Local Board provided status updates on key WIOA provisions.

 

Local Boards were initially required to complete an “Existing Local Area” application for initial designation and submit it to the State of California EDD no later than March 31, 2015.  Upon approval of its initial designation as a Local Board, the Monterey County Workforce Development Board was certified through June 30, 2016.   

 

In accordance with the WIOA criteria for subsequent designation of local areas and certification of local boards, Monterey County Workforce Development Board has met the following requirements:

 

(1)                     It has met the membership provisions in the WIOA Section 107(b);

(2)                     It has met and or exceeded its local performance goal on each performance measure for PY’s 2013-14 and 2014-15;

(3)                     It has successfully demonstrated sustained fiscal integrity as demonstrated by State of California monitoring reviews for PY’s 2013-14 and 2014-15;

(4)                     It has demonstrated steps taken toward implementation of key WIOA provisions and is moving towards a unified, customer-focused system, as defined in the Local Board Recertification application (attached).

 

As permitted by the EDD Directive, the Monterey County Workforce Development Board submitted an unsigned application on March 31, 2016.  Signed applications are due to EDD by June 20, 2016.   The Board is asked to approve the unsigned application submitted to EDD and to authorize the Chairpersons of the Monterey County Workforce Development Board and the Board of Supervisors to sign it.

 

OTHER AGENCY INVOLVEMENT:

The unsigned application was reviewed by County Counsel as to form, after it was submitted to EDD.

 

FINANCING:

This application has no effect on the general fund. Receipt of WIOA funds, through future formula allocations approved by the State Employment Development Department Workforce Services Division, is contingent upon Local Area Designation under the Workforce Innovation and Opportunity Act of 2014.
