Title: a. RECOMMENDATION:

It is recommended that the Board of Supervisors:

a. Approve and authorize the Director of Health or Assistant Director of Health to execute a new three (3) year Mental Health Services Agreement between the County of Monterey and Emmanuel Inneh DBA Monterey Bay Guest Home II in Salinas, CA for the provision of board and care services for Monterey County adult residents with severe psychiatric disabilities in the amount of $233,600 for Fiscal Year (FY) 2022-23, $233,600 for FY 2023-24, and $233,600 for FY 2024-25, for a maximum County obligation of $700,800 for the retroactive term of July 1, 2022 through June 30, 2025; and

b. Approve non-standard insurance provision in Agreement as recommended by the Director of Health; and

SUMMARY/DISCUSSION:

The County has maintained Agreement A-14353 with Emmanuel Inneh DBA Monterey Bay Guest Home II in Salinas, CA, which expired on June 30, 2022.  Monterey Bay Guest Home II provides 40 additional beds to County residents, in addition to the 22 beds currently provided by the original Monterey Bay Guest Home facility in Seaside, CA, which the County currently contracts with under Agreement A-14768.  This new Agreement continues those provisions an additional three-years, through FY 2022-25, with a modest 2.2% increase per year ($1 per day per client) factored into the Contract to counter significant increases in facility operating costs due to inflation.  Both Monterey Bay Guest Homes are licensed by the State of California Department of Social Services as Adult Residential Facilities. Their facilities provide community-based living that creates a normalizing experience for adults with severe psychiatric disabilities, as defined in Section 1502 of the Health and Safety Code. 

 

Approval of this Agreement provides for expanded care for Monterey County Behavioral Health Bureau adult clients with severe psychiatric disabilities and complies with the requirements of the Welfare and Institutions Code Section 5600 (Bronzan-McCorquodale Act).

 

This Agreement contains a non-standard insurance provision of claims-based coverage.  This Agreement contains the County’s standard 30-day “no cause” provision (Section IV, B) and an additional defunding provision (Section IV, D), which provides the County the ability to amend or terminate the Agreement in the event of a reduction and/or termination of funding.

 

This agreement is late in being presented to your board and is retroactive to July 1, 2022 due to a confluence of events, including the processing of other renewing agreements, delays in correct insurance being provided to the County by the vendor as required by County Risk Management, and contract department approvals being delayed by vacations.

 

This work supports the following Monterey County Health Department 2018-2022 Strategic Plan Goal: 3. Ensure access to culturally and linguistically appropriate, customer-friendly, quality health services.  It also supports one of the ten essential public health services, specifically: 7. Link people to needed personal health services and assure the provisions of health care when otherwise unavailable.

 

OTHER AGENCY INVOLVEMENT:

The office of the County Counsel, Risk Management, and Auditor-Controller have reviewed and approved this Agreement as to legal form, non-standard Insurance provisions, and fiscal provisions, respectively.

 

FINANCING:

This Agreement is 100% funded by 1991 Realignment revenues.  The funds for this Agreement ($233,600) are included in the Health Department’s Behavioral Health (HEA012, Unit 8410) Fiscal Year (FY) 2022-23 Adopted Budget.  The funds for this Agreement for FY 2023-24 ($233,600) and FY 2024-25 ($233,600) will be included in the respective Health Department’s Behavioral Health (HEA012, Unit 8410) FY 2023-24 and FY 2024-25 Requested Budgets.
