a. Approve Amendment No.1 to Professional Services Agreement No. A-12164 with Kimley-Horn and Associates, Inc. to provide for the inclusion of additional engineering services for the analysis of corridor improvements on Carmel Valley Road to provide the Countywide Fee Program Nexus Study; Agriculture and Winery Corridor Plan Impact Fee based on the recent adoption of the General Plan Update; Carmel Valley Transportation Improvement Program Traffic Analysis and Fee Calculation; and California Environmental Quality Act Environmental Review for the Carmel Valley Transportation Improvement Program in the amount of $97,090 for a total amount not to exceed $352,253, and extend the term to December 31, 2013; and
b. Authorize the Contracts/Purchasing Officer to execute Amendment No. 1 to Professional Services Agreement No. A-12164 and future amendments that do not significantly alter the scope of work or change the approved Agreement amount.

RECOMMENDATIONS:
It is recommended that the Board of Supervisors:

SUMMARY/DISCUSSION:
On December 13, 2011, the Board of Supervisors approved Professional Services Agreement (PSA) No. A-12164 with Kimley-Horn and Associates, Inc. (KHA) in the amount of $255,163 to provide engineering services associated with the Countywide Fee Program Nexus Study; Agriculture and Winery Corridor Plan Impact Fee based on the recent adoption of the General Plan Update; Carmel Valley Transportation Improvement Program (CVTIP) Traffic Analysis and Fee Calculation; and California Environmental Quality Act (CEQA) Environmental Review for the CVTIP, for a term to June 30, 2013.
Amendment No. 1 to PSA No. A-12164 with KHA is necessary to include additional engineering services for the analysis of corridor improvements on Carmel Valley Road. These additional services were requested by the Carmel Valley residents to identify opportunities for operational improvements. Amendment No. 1 will allow for the additional analysis as well as for completion of the outstanding engineering services, increase the amount of the PSA by $97,090, for a total amount not to exceed $352,253, and extend the term to December 31, 2013.
OTHER AGENCY INVOLVEMENT:
The Office of the County Counsel, and Auditor-Controller, have reviewed and approved Amendment No. 1 as to form and legality, and fiscal provisions, respectively. Due to the late submission of this Board Report, the CAO Budget and Analysis Division was not provided adequate time to fully review for potential fiscal, organizational policy, or other implications to the County of Monterey.
FINANCING:
There is no financial impact to the General Fund. The cost of the proposed Amendment No. 1 and associated costs for staff time in managing the services will be funded by the Road Fund (Fund 002, Carmel Valley Traffic Impact Fees Account 2653).
