b. Authorize the Director or Assistant Director of Health to sign up to three (3) amendments to this agreement where the amendments do not significantly alter the scope of work or change the approved agreement amount by more than ten percent (10%).

RECOMMENDATION:
It is recommended that the Board of Supervisors:
a. Approve and authorize the Director or Assistant Director of Health to sign an agreement between Monterey County Health Department, Environmental Health Bureau and Disaster Kleenup Specialist, Inc for Lead Paint Remediation services for a total amount not to exceed $200,000 for a term retroactive to May 1, 2022 through April 30, 2024; and
b. Authorize the Director or Assistant Director of Health to sign up to three (3) amendments to this agreement where the amendments do not significantly alter the scope of work or change the approved agreement amount by more than ten percent (10%).
SUMMARY/DISCUSSION:
The agreement will provide services for the abatement of lead paint in homes identified by the Environmental Health Lead Abatement Project Manager and is funded through litigation (settlement) funds. This Residential Lead Abatement Project is part of the Environmental Health’s Consumer Health Protection Program for the County of Monterey Health Department Environmental Health Bureau. The Residential Lead Abatement Program has been created to implement a lead hazard assessment and abatement program for privately owned residential structures in the County of Monterey that is being funded through a court ordered judgment. Currently, housing units have been identified in the County of Monterey that were constructed prior to 1978. This agreement provides for a certified lead abatement contractor to remediate homes that have been identified by the Environmental Health Lead Abatement Project Manager as having lead contaminated paint.
A Request for Proposal was launched on September 23,2021 (Request for Proposal No.10740) however no bids were submitted. Due to the need for lead remediation services, a contractor was identified. Additional contractors will also be identified as this need is not exclusive nor limited to only one contractor.
The Staff of the Environmental Health Bureau is dedicated to safeguarding the residents and resources of Monterey County by providing services that help promote responsible business practices, by providing educational opportunities to industry workers and the public, and when necessary, by enforcing Environmental Health principles and law.
Consumer Health Protection Services (CHPS) is responsible for retail food protection and cottage food operations regulation, substandard rental housing inspections, recreational and beach water quality monitoring, public swimming pools and spas inspection, vector control, agricultural field toilet inspections, tobacco licensing inspections, the Childhood Lead Poisoning Prevention Program, and other general health protection activities.
Disaster Kleenup Services, Inc will provide lead-based paint inspection and lead hazard abatement services. All services to be provided are to be compliant with State, Federal, and Local regulatory requirements.
This work supports the Monterey County Health Department 2018-2022 Strategic Plan Goals: 1. Empower the community to improve health. It also supports the following of the ten essential public health services, specifically: 2 Diagnose and investigate health problems and health hazards in the community and 6. Enforce laws and regulations that protect health and ensure safety.
OTHER AGENCY INVOLVEMENT:
The Office of the County Counsel-Risk Management and Auditor-Controller’s Office have reviewed and approved this agreement as to form and legality, and fiscal provisions, respectively.
FINANCING:
These services are funded by Lead Mitigation Settlement Funds and are included in the annual budget for 4000-Environmental health Unit 8112.
