a. Approve a retroactive agreement and authorize the Contracts/Purchasing Officer or his designee to sign a retroactive Agreement with Historic Sportscar Racing, LLC to provide sanctioning body services for Pre-Reunion and Rolex Monterey Motorsports Reunion to WeatherTech Raceway Laguna Seca (WRLS) retroactive from February 1, 2021 through December 31, 2022, for an amount not to exceed $228,000;
b. Accept non-standard risk terms with respect to insurance provisions in the Agreement; and
c. Approve and authorize the Contracts/Purchasing Officer or his designee to execute up to three (3) future amendments to this Agreement where the total amendments do not exceed 10% ($22,800) of the agreement amount and do not significantly change the scope of work.

RECOMMENDATION:
It is recommended that the Board of Supervisors:
a. Approve a retroactive agreement and authorize the Contracts/Purchasing Officer or his designee to sign a retroactive Agreement with Historic Sportscar Racing, LLC to provide sanctioning body services for Pre-Reunion and Rolex Monterey Motorsports Reunion to WeatherTech Raceway Laguna Seca (WRLS) retroactive from February 1, 2021 through December 31, 2022, for an amount not to exceed $228,000;

SUMMARY/DISCUSSION:
A&D Narigi Consulting, LLC requests retroactive approval of a 2-year agreement with Historic Sportscar Racing LLC. This firm will replace Historic Motor Sports Association as the sanctioning body for the Pre-Reunion and Rolex Monterey Motorsports Reunion for 2021 and 2022 at WeatherTech Raceway Laguna Seca.
An agreement with Historic Sportscar Racing, LLC will replace the prior agreement with Historic Motor Sports Association’s agreement which was terminated on August 28, 2020 and effective September 30, 2020 due to management’s desire to proceed in a new and fresh direction for the annual events. Historic Sportscar Racing’s annual agreement is less than Historic Motor Sports Association, while providing additional needed services.
The sanctioning body is required for the Pre-Reunion and Rolex Monterey Motorsports Reunion to provide key services, such as:
• Setting of rules for car preparation, safety and driver conduct
• Rules to be documented for use by selection committee
• Distribution of information to registered entrants with confirmation, and proper recording of information in WRLS database
• Be available to entrants for questions, etc., during normal business hours
• Onsite for participant load-in through completion of event
• Work with governance and selection committee in the evaluation of cars as the technical advisor
• Final sign off regarding all technical items relating to the vehicles
• Complete onsite registration
• Assist in paddock layout
• Conduct all on-track race activity in coordination with SCCA corner marshals and grid
• Conduct driver meetings
The Workers Compensation provision is waived, per County Counsel-Risk Management, by letter of certification attesting that Historic Sports Car Racing, LLC has no California employees, nor hired independent contractors that are residents of the state of California. As a Florida-based LLC with fewer than four employees, Florida does not require workers compensation insurance.
According to A&D Narigi, LLC, the Historic Sportscar Racing, LLC will provide the professional expertise and tasks outlined in the agreement for the Pre-Reunion and Rolex Monterey Motorsports Reunion and will perform to the expectations and requirements as defined in the agreement.
OTHER AGENCY INVOLVEMENT:
The Office of County Counsel has reviewed and approved the Agreement as to form.
FINANCING:
The agreement with Historic Sportscar Racing, LLC will be funded through Fund 453 Laguna Seca Budget Unit 8536. Funding for the Agreement is included in the FY 2020-2021 Approved Budget. Approval of the recommended action will have no additional impact on the County General Fund.
