RECOMMENDATION:

 

Approve and authorize the Director of Child Support Services to sign a Plan of Cooperation (POC) with California Department of Child Support Services (DCSS), and all future amendments approved by County Counsel, to define responsibilities for securing child support, including child support establishment, collection, and disbursement services; medical support; determining paternity; and providing other public services in accordance with the provisions of Title IV-D of the Social Security Act for the period of October 1, 2019 through September 30, 2020. The POC, by its terms, renews automatically each year but, if amended, will be submitted to the Board of Supervisors for review and approval at least once every three years.

 

 

SUMMARY:

 

The Child Support Enforcement Program is a federally-mandated, state-supervised, County-administered program. All direct and indirect local program costs are funded at a 66% federal participation rate and the state provides the remaining 34%.

 

This Plan of Cooperation defines responsibilities of DCSS and Monterey County Department of Child Support Services for securing child support, including child support establishment, collection, and disbursement services; medical support; determining paternity; and providing other public services in accordance with the provisions of Title IV-D of the Social Security Act.

 

This POC will commence on October 1, 2019, and shall automatically renew at the end of the term, and is subject to amendment as necessary to reflect new or revised state and federal laws, regulations, and requirements. The POC will be submitted to the Board of Supervisors for review and approval at least once every three years if it has been amended since its most recent submittal to the Board.

 

This POC may be amended by a written agreement of both parties if required by changes in policies or directives that may occur during the term of this POC.  All such proposed amendments will be reviewed by County Counsel before Monterey County Department of Child Support Services consents to them.

 

 

OTHER AGENCY INVOLVEMENT:

County Counsel has reviewed and approved the POC as to legal form.

 

 

FINANCING:

 

The program is fully funded by Federal (66%) and State (34%) funds and no County General Fund contributions are required.
