RECOMMENDATIONS:
It is recommended that the Board of Supervisors:
 
a. Ratify awarding of an emergency construction contract to Monterey Peninsula Engineering, the lowest responsible bidder, for the Reservation Road Slipout, Project No. 14-156965, in the total amount of $455,220;
 
b. Ratify approval of the Performance and Payment Bonds executed and provided by Monterey Peninsula Engineering;
 
c. Ratify authorizing a contingency (not to exceed 10% of the contract amount) to provide funding for approved contract change orders;
 
d. Ratify the execution of the contract and the approval of change orders to the contract that did not exceed 10% of the original contract amount, and did not significantly change the scope of work, by the Director of Public Works; and
 
e Authorize the Director of Public Works to execute a Certificate of Completion and record a Notice of Completion with the County Recorder when he determines that the Contract is complete in all respects in accordance with the Plans and Special Provisions for the construction of the Reservation Road Slipout, Project No. 14-156965, performed by Monterey Peninsula Engineering.
 
SUMMARY/DISCUSSION:
Following the recent rains, a section of slope along Reservation Road eroded causing a slip out of the pavement adjacent to the travel way.  The Resource Management Agency - Public Works (RMA - PW) installed sandbags and delineators to close the road shoulder and stop further erosion in the immediate area.  However, to safely reopen the road shoulder, the slope needed to be repaired, drainage down drains replaced, and asphalt pavement patched.  RMA - PW solicited bids from four local contractors under an emergency contract to perform this work.  Monterey Peninsula Engineering was the lowest responsive bidder with a bid of $455,220.  The other bidders were Granite Construction Company, Granite Rock Company, and The Don Chapin Company.  The Engineer's Estimate was $492,520 for the Project.
 
OTHER AGENCY INVOLVEMENT:
The Office of the County Counsel, and Contracts/Purchasing, attended the bid opening and reviewed the low bid for conformance with applicable regulations.  The Office of the County Counsel, and Risk Management, approved the Contract and Bonds as to form, and insurance provisions, respectively.  This item was presented to the Budget Committee and Capital Improvement Committee on May 28, 2014 and June 2, 2014, respectively.
 
FINANCING:
There is no financial impact to the General Fund.  Total Estimated Project Cost, Engineering, Construction Management and Construction are $710,508.  The Project is funded by Fund 002, Unit 8195, Appropriation Unit RMA012.
