RECOMMENDATION:
It is recommended that the Board of Supervisors:
 
a. Award a contract to The Don Chapin Company, Inc., the lowest responsible and responsive base bidder for the construction of Castroville Boulevard Overlay, Project No. 14-157165, with the base bid amount of $1,091,329 and additive alternate amount of $190,092 for a total contract amount of $1,281,421;
 
b. Approve the Performance and Payment Bonds executed and provided by The Don Chapin Company, Inc.;
 
c. Authorize a contingency (not to exceed 10% of the contract amount) to provide funding for approved contract change orders;
 
d. Authorize the Director of Public Works to execute the contract and, subject to the terms of the Public Contract Code, approve change orders to the contract that do not exceed 10% of the original contract amount, and do not significantly change the scope of work; and
 
e. Authorize the Director of Public Works to execute a Certificate of Completion and record a Notice of Completion with the County Recorder when he determines that the contract is complete in all respects in accordance with the Plans and Special Provisions for the construction of Castroville Boulevard Overlay, Project No. 14-157165, performed by The Don Chapin Company, Inc.
 
SUMMARY/DISCUSSION:
On February 25, 2014, the Board of Supervisors adopted the Plans and Special Provisions for Castroville Boulevard Overlay, Project No.14-157165.  The Project was advertised and the bids were opened on March 28, 2014.  The lowest responsible base bidder was The Don Chapin Company, Inc., with a base bid amount of $1,091,329; and an additive alternate bid amount of $190,092 for a total bid amount of $1,281,421.  The Engineer's Estimate was $1,236,765 for the base bid and $163,520 for the additive alternate for a total of $1,400,285.  This project is to be constructed in conjunction with the Castroville Boulevard Pavement Delineation project.  Project construction is scheduled to begin in June, 2014.
The project consist of hot mix asphalt concrete paving including but not limited to slurry seal, cold plane asphalt concrete, clearing and grubbing, and traffic control.  The limit of the project is from State Route 156 to San Miguel Canyon Road.  The proposed project will improve safety for the public.
 
The project has been determined to be categorically exempt (Class 1) from the California Environmental Quality Act (CEQA) because it is to perform repair and maintenance of existing streets and similar facilities, which involves no expansion of an existing use. OTHER AGENCY INVOLVEMENT:
The Office of the County Counsel and Contracts/Purchasing attended the bid opening and reviewed all bids for conformance with applicable regulations.  The Office of the County Counsel, Auditor-Controller, and Risk Management have reviewed and approved the contract documents as to form and legality, fiscal terms, and insurance provisions, respectively.
 
FINANCING:
There is no financial impact to the General Fund.  Total estimated project cost, including project management, engineering, and construction, is $1,696,966.  The project is funded from Gas Tax in the amount of $119,466 and a portion of the Board approved allocation of Transient Occupancy Tax (TOT) to the Road Fund in the amount of $1,577,500.  The Gas Tax contribution is to fund the majority of the contingency, for approved contract change orders.  The TOT to the Road Fund is based on the formula approved by the Board as part of the FY 2013-14 Adopted Budget.  In FY 2013-14, the approved formula provides 20% of the County's FY 2012-13 estimated year-end TOT revenue to the Road Fund to help improve and maintain County roads.  Based on this formula, the current year TOT to the Road Fund is approximately $3,577,500, of which $2,000,000 is assigned to the County's Chip Seal Program and $1,577,500 has been assigned to this project.
