Harper Certified Public Accountant (CPA) & Associates for the provision of financial analysis of proposals received in response to ambulance Request for Proposals and annual rate adjustments for a period of five years from April 1, 2023, to March 31, 2028, for a total amount not to exceed $41,080.
b. Approve nonstandard indemnification provisions as recommended by the Director of Health.
c. Authorize the Director of Health, the Assistant Director of Health, or the Emergency Medical Services Director to sign up to three (3) amendments to this Agreement where the combined amendments do not exceed 10% ($4,108) of the original Agreement amount and do not significantly change the scope of the Agreement.

RECOMMENDATION:
It is recommended that the Board of Supervisors:

SUMMARY/DISCUSSION:
The Health Department seeks authorization to execute an Agreement between the County of Monterey and Kevin Harper CPA & Associates for the provision of financial analysis services of proposals received in response to a Request for Proposal (RFP) for 911 Emergency Ambulance Service and to conduct periodic analysis of the contracted ambulance provider year-end financial reports to validate requested annual rate adjustments.
The Monterey County Department of Health’s EMS Agency is designated by the Monterey County Board of Supervisors, pursuant to California Health and Safety Code, Section 1797.200, as the Local EMS Agency. The local EMS Agency is responsible to plan, implement, and evaluate the Emergency Medical Services System, consisting of organized patterns of readiness and response services based on public and private Agreements and operational procedures. The Local EMS Agency is also responsible to implement advanced life and basic life support systems, and to establish policies and procedures approved by the Medical Director of the Local EMS Agency to assure medical control of the EMS system.
Consistent with California Health and Safety Code, Section 1797.224, the Local EMS Agency has designated the whole of Monterey County as an Exclusive Operating Area (EOA), except for: (1) certain areas served by the Carmel Fire Department and the Monterey County Regional Fire Protection District; and (2) the area within US Army Garrison Fort Hunter Liggett. Within the Monterey County EOA, the contracted ambulance provider is the sole and exclusive provider of ambulance transport services including interfacility transports, except for transports of certain County mental health patients and authorized mutual aid responses.
The Monterey County EMS 911 ambulance EOA has been served by a single contracted ambulance provider since January 30, 2010. This contract expires on June 20, 2025. The Monterey County EMS Agency must select, through a competitive process, an ambulance service provider by 2024 to allow ample time for the selected provider to begin services on July 1, 2025. Given the complexity of the project, the EMS Agency wishes to secure the services of a consultant to support the EMS Agency in this endeavor. The Agreement contains nonstandard indemnity provisions that limit the vendors’ liability but do not pose a high risk to the County.
This work supports the Monterey County Health Department 2018 - 2022 Strategic Plan Initiative 2. Enhance public health & safety through prevention and 4. Engage the MCHD workforce & improve operational functions to meet current & developing population health needs. It also supports two of the ten essential public health services, specifically, 3. Inform, educate, and empower people about health issues, and 9: Evaluate effectiveness, accessibility, and quality of personal and population-based health services.
OTHER AGENCY INVOLVEMENT:
County Counsel has approved the Agreement as to form.
FINANCING:
There will be no impact on the General Fund from this action. The cost of the services to be provided under the proposed Agreement would be covered by the CSA-74 special tax (Fund 092). The funds for this Agreement for FY 2022-23 and FY 2023-24, FY 2024-25, FY2025-26, and FY26-27 will be included in the Health Department’s Emergency Medical Services Bureau (HEA006, Unit 8109) respective Recommended Budgets.
