a. Approve and authorize the Monterey County Laguna Seca Representative to execute a retroactive Standard Agreement between Blue Triton Brands Inc., dba Ready Refresh and the County of Monterey for drinking water, rental coolers, and other specialty beverages for Laguna Seca Recreation Area and WeatherTech® Raceway at Laguna Seca (WRLS) with a term beginning January 1 through December 31, 2024, for an amount not to exceed $40,000;
b. Up to 3 future amendments to the Standard Agreement where each amendment does not exceed 10%, or $4,000, of the agreement amount and each does not significantly change the scope of work, subject to County Counsel approval for a total not to exceed aggregate sum of $52,000.

RECOMMENDATION:
It is recommended that the Board of Supervisors:
a. Approve and authorize the Monterey County Laguna Seca Representative to execute a
retroactive Standard Agreement between Blue Triton Brands Inc., dba Ready Refresh and the County of Monterey for drinking water, rental coolers, and other specialty beverages for Laguna Seca Recreation Area and WeatherTech® Raceway at Laguna Seca (WRLS) with a term beginning January 1, 2024 through December 31, 2024, for an amount not to exceed $40,000;
b. Up to 3 future amendments to the Standard Agreement where each amendment does not exceed 10%, or $4,000, of the agreement amount and each do not significantly change the scope of work, subject to County Counsel approval for a total not to exceed aggregate sum of $52,000.
SUMMARY/DISCUSSION:
Blue Triton Brands Inc. (Blue Triton) dba Ready Refresh was formerly under the Nestle Waters North America umbrella. Blue Triton is an independent beverage company with a robust North American supply chain which includes one of the largest reusable beverage container networks in the U.S. Laguna Seca Recreation Area (LSRA) does not have potable water on site. Providing safe and clean drinking water for use in our hospitality suites, sold through the raceway store and offices is essential to the health of LSRA visitors and staff.
Staff requests the Board of Supervisors approve the proposed retroactive Standard Agreement (Attachment A) with Blue Triton Brands Inc. dba Ready Refresh for the term beginning January 1, 2024 through December 31, 2024, with a not to exceed value of $40,000 up to 3 future amendments where each amendment does not exceed 10%, or $4,000, of the agreement amount and each does not significantly change the scope of work, subject to County Counsel approval for a total not to exceed amount of $52,000.
OTHER AGENCY INVOLVEMENT:
The Office of County Counsel and Auditor-Controller’s Office reviewed and approved the proposed Agreement as to form and fiscal provisions, respectively.
FINANCING:
The cost of the contracted services provided by Blue Triton Brands Inc. dba Ready Refresh shall not exceed $40,000 for the duration of the agreement. This cost will be financed by the available budget in the Laguna Seca Recreation Area Fiscal Year 2023-2024 adopted budget in Fund 453, Appropriation Unit PFP067 to cover the fees in this Agreement for Fiscal Year 2023-24. Future costs for services for the remainder of the agreement will be included in Fiscal Year 2024-25 Recommended Budget in Fund 453, Appropriation Unit PFP067.
BOARD OF SUPERVISORS STRATEGIC INITIATIVES:
The recommended action supports the Board of Supervisors Strategic Initiatives for Economic Development and Health and Human Services. Providing safe drinking water is essential in maintaining a healthy and safe environment for our guests at LSRA. This in turn will generate revenue that is intended to finance WRLS operations and maintenance.
