Approve and authorize the Director of Public Works, Facilities, & Parks, or designee, to sign the Master Agreement Administering Agency-State Agreement for State-Funded Projects (State Master Agreement No. 05-5944S21) and related Program Supplement Agreements with the California Department of Transportation (Caltrans).

RECOMMENDATION:

It is recommended that the Board of Supervisors approve and authorize the Director of Public Works, Facilities, & Parks, or designee to sign the Master Agreement Administering Agency-State Agreement for State-Funded Projects (State Master Agreement No. 05-5944S21) and related Program Supplement Agreements with the California Department of Transportation (Caltrans).

 

SUMMARY/DISCUSSION:

The Legislature of the State of California has enacted legislation by which certain state funds are made available for use on local transportation related projects of public entities qualified to act as recipients of these state funds.  The County of Monterey has applied to the California Transportation Commission (CTC) or State for funding from a state-funded program for use on local authorized transportation related projects as a local administered project(s) which will not receive any federal funds.  Projects allocated with state funds will be administered in accordance with the current CTC State Transportation Improvement Program (STIP) Guidelines, applicable chapter(s) of the Local Assistance Procedures Guidelines (LAPG), Local Assistance Procedures Manual (LAPM) and/or any other instructions published by the State. 

 

The proposed State Master Agreement No. 05-5944S21 between the California Department of Transportation (Caltrans) and the Administering Agency (County of Monterey) (Attachment A) would establish terms and conditions applicable to the County when receiving state funds for a designated project facility and to the subsequent operation and maintenance of that completed facility.  The State Master Agreement includes standard provisions relating to project administration, management, and maintenance, as well as fiscal and special provisions common to all projects. 

 

Caltrans prepares project specific Program Supplement Agreements, or a supplement to the State Master Agreement, which formalize the financial responsibilities and provisions for a specific state-aid funded project.  Program Supplement Agreements identify the types and amounts of federal, state, and local funds used to finance the locally sponsored project.  Program Supplement Agreements provide the contractual basis for the State to pay the local agency for work done.  Special covenants or clauses in the Program Supplement Agreement define the local agency’s specific responsibilities in implementing and maintaining the project.  No reimbursement payments can be made to a local agency by Caltrans until the Program Supplement Agreement has been fully executed.  Program Supplement Agreements must be accepted and signed on behalf of the County by an authorized official approved by the Board of Supervisors. 

 

Therefore, the Department of Public Works, Facilities, & Parks (PWFP) seeks Board authorization to designate the Director of PWFP, or designee, to sign the subject State Master Agreement No. 05-5944S21 and related Program Supplement Agreements with Caltrans.

 

PWFP pursues federal and state funding for several projects during each fiscal year, and therefore requests that the Director of PWFP, or designee, be the official, duly authorized by the Board to approve and sign the attached State Master Agreement No. 05-5944S21 and related Program Supplement Agreements on behalf of the County for any existing and future projects that fall under this State Master Agreement.

 

OTHER AGENCY INVOLVEMENT:

Caltrans approves the proposed designation of the Director of PWFP, or designee, as the authorized County official to accept and sign the proposed State Master Agreement and related Program Supplement Agreements on behalf of the County.  Other counties currently use a similar funding acceptance procedure.

 

FINANCING:

State funding provided through the State Master Agreement and related Program Supplemental Agreements are for County Roads, Bridges, and related construction projects.  Revenue received pursuant to Program Supplemental Agreements is deposited into the Road Fund toward reimbursement of project expenditures,
