RECOMMENDATION:
It is recommended that the Board of Supervisors:
a. Approve and authorize the Assessor to enter into a Two Year Agreement on Behalf of Monterey County for a Petroleum and Geothermal Property Sales Study between California Assessor's Association Members and Harold W. Bertholf, Inc. retroactive to November 1, 2016 through October 31, 2018; and
b. Accept non-standard contract provisions as recommended by the Assessor.
SUMMARY/DISCUSSION:
The participating Assessors in counties containing oil, gas, and geothermal energy-producing properties regularly exchange relevant valuation information on an individual basis and are in need of a means to gather, coordinate and analyze sales and property information data from oil, gas and geothermal energy-producing property sales throughout California. Because this Agreement is entered into as part of a Joint Powers Agreement with other California counties, the Assessor must obtain the approval of the Board of Supervisors to execute the Agreement. Monterey County has successfully participated in this coordination and cooperation through a similar, if not identical, agreement for over ten years, and this Agreement effectively is the renewal of this profitable service. The annual cost to the Monterey County Assessor’s Office for the two (2) year term of November 1, 2016 through October 31, 2018 is $990 per year.
OTHER AGENCY INVOLVEMENT:
County Counsel has reviewed and approves the Agreement as to form. The terms are non-standard, but are not detrimental to Monterey County. The indemnification terms appear to provide greater protection to the County than the standard County terms.
FINANCING:
The annual cost to the Monterey County Assessor’s Office for the two (2) year term, retroactive to November 1, 2016 through October 31, 2018, is $990.00 per year. There is no impact to the County General Fund, as the cost is within the Assessor’s Adopted Budget (1180-ACR001-8003) for the recommended action.
