RECOMMENDATION/SUMMARY:
a. Approve and authorize the Library Director to execute a three-year Memorandum of Understanding (“MOU”) for an agreement term retroactive from May 31, 2025 to May 30, 2028 with the Friends of the Marina Library to partner with Monterey County on Behalf of the Monterey County Free Libraries, and
b. Authorize the Library Director to execute up to two future annual amendments to the agreement that do not significantly alter the scope of work
DISCUSSION:
The Monterey County Free Libraries (MCFL) started the first MOU with the Friends of the Marina Library (Friends) in 2021 (Item 35 7/20/2021), to clarify partnership obligations and opportunities for programs and services from the Marina Library (190 Seaside Circle, Marina CA). This was the first MOU structured between MCFL and a Friends group. MCFL has since signed similar MOUs clarifying obligations and responsibilities with the Friends of the Prunedale Library, Friends of the Seaside Library, Friends of the Andy Ausonio Library (Castroville), Friends of the Library Big Sur, Friends of the Carmel Valley Library, and Friends of the King City Library. Each Friends group operates independently, and MCFL built upon the Friends of the Marina Library model, working with each Friends group to structure what best served each community.
This partnership has resulted in ongoing and growing programming and service opportunities for the public for all ages, led and managed by the robust and dedicated volunteer efforts of the Friends of the Marina Library. The MOU was extended one time for an additional year. The Friends and MCFL have engaged in ongoing communication, collaboration, and work to ensure the partnership is a success.
This MOU incorporates changes developed through MCFL’s creation of more MOUs with other organizations, to bring in learning through collaboration. For example, the obligation for the Friends to secure any additional licenses, permits, or permissions for their activities, and managing items owned by the Friends though stored on the Library site. The retroactive term is due to time for MCFL and the Friends to work together on the new language in the MOU.
This MOU is intended to maintain an ongoing partnership, detail obligations and responsibilities for both agencies, enable the Friends to fulfill their mission, and ensure appropriate liability coverage for these offerings.
OTHER AGENCY INVOLVEMENT:
County Counsel has reviewed and approved the MOU as to legal form.
FINANCING:
The MOU contains no financial provisions between the two agencies, and will not impact the General Fund.
