Title: a. RECOMMENDATION:

It is recommended that the Board of Supervisors:

a.                      Approve and authorize the Director of Health or Assistant Director of Health to execute a three-year Mental Health Services Agreement with Dycora Transitional Health - San Jose, LLC for the provision of mental health services to gravely disabled Monterey County adult residents with severe psychiatric disabilities in a secure Skilled Nursing Facility as an Institution for Mental Disease (IMD), for a maximum County obligation of $2,694,102 retroactive to July 1, 2017 through June 30, 2020; and

b.                     Approve and authorize the Director of Health or Assistant Director of Health to approve up to three (3) future amendments that do not exceed ten percent (10%) ($269,410) of the original Agreement amount and do not significantly alter the scope of services.

 

SUMMARY/DISCUSSION:

The County currently maintains Agreement A-12733 with Dycora Transitional Health - San Jose, LLC (formerly Beverly Health and Rehabilitation Services, Inc. dba Golden Living Center San Jose) which will expire on June 30, 2017.  Dycora Transitional Health - San Jose, LLC is a Skilled Nursing Facility, Institution for Mental Disease for adults with psychiatric impairments and disabilities that require a locked skilled nursing level of care.  Treatment services include individualized programs to meet the specific needs of each client and a structured regimen with individualized services to assist clients in their development of new skills. 

 

This new Agreement with Dycora Transitional Health - San Jose, LLC continues the provisions of the expiring contract, and based on past demand and usage allocates funding for up to 10 Monterey County residents.  Approval of this Agreement meets the requirements of the State Welfare and Institutions Code 5600 (Bronzan-McCorquodale Act) and the California Code of Regulations Titles 9 and 22, and sustains the continuity of care services to seriously mentally ill clients of Monterey County.

 

This Agreement is delayed in being brought before your Board because the vendor required 60 days to comply with standard Insurance requirements as outlined by County of Monterey Risk Management.

 

This Agreement contains the County’s standard 30-day “no cause” provision (Section IV, B) and an additional defunding provision (Section IV, D), which provides the County the ability to amend or terminate the Agreement in the event of a reduction and/or termination of funding.

 

This work supports the following Monterey County Health Department 2011-2015 strategic plan initiative: 3) Ensure access to culturally and linguistically appropriate, customer-friendly, quality health services.  It also supports one of the ten essential public health services, specifically: 7) Link people to needed personal health services and assure the provisions of health care when otherwise unavailable.

 

OTHER AGENCY INVOLVEMENT:

County Counsel and Auditor-Controller have reviewed and approved this Agreement as to legal form and fiscal provisions, respectively.

 

FINANCING:

This Agreement is 100% funded by 1991 Realignment revenues.  The funds for this Agreement ($868,043) will be included in the Health Department’s Behavioral Health (HEA012, Unit 8410) Fiscal Year 2017-18 Adopted Budget.  The funds for this Agreement for FY 2018-19 ($897,681) and FY 2019-20 ($928,378) will be included in the respective Health Department’s Behavioral Health (HEA012, Unit 8410) FY 2018-19 and FY 2019-20 Requested Budgets.
