RECOMMENDATION:
It is recommended that the Board of Supervisors:
a. Approve supplemental responses to the 2019-2022 Monterey County Civil Grand Jury Report titled “Monument to a Failed Process: South County Permit PLN 180317”; and
b. Authorize the County Administrative Officer to submit the approved response to the Presiding Judge of the Superior Court, County of Monterey, by January 31, 2024.
SUMMARY/DISCUSSION:
The 2019-2022 Monterey County Civil Grand Jury Report titled “Monument to a Failed Process: South County Permit PLN 180317” was issued in June 2020. On August 28, 2019, the Board of Supervisors authorized submittal of approved responses to the Presiding Judge of the Superior Court by September 21, 2019.
On December 7, 2023, the County received notification (Attachment A) from the Grand Jury highlighting missing required responses to the subject report. Recommended responses to findings and recommendations outlined in the report are enclosed as Attachment B for the Board’s consideration. The Board’s approved response should be deemed by the Monterey County Civil Grand Jury and the Judge of the Superior Court, County of Monterey, as the response of the Board of Supervisors to those issues raised by the Civil Grand Jury regarding County operations, except as applicable to elected County officials.
The recommended response is intended to reflect staffs’ understanding of Board policy. Should modifications to the recommended responses be warranted, the Board is requested to direct staff to return with those changes at the February 6, 2024, Board of Supervisors meeting.
OTHER AGENCY INVOLVEMENT:
The County Administrative Office coordinated responses with the department of Housing and Community Development (formerly under the preceding Resource Management Agency), and Office of the County Counsel. Members of the 2023 - 2024 Monterey County Civil Grand Jury were invited to attend the Board of Supervisors hearing on this matter.
FINANCING:
There are no fiscal impacts to the General Fund with associated with this report.
