Set a public hearing for June 23, 2026, at 1:30 p.m. to:
a. Accept the report of delinquent fees, as indicated in the “Report of 2025 Delinquent Waste Hauling Fees in the Unincorporated Area” from USA Waste of California, Inc. DBA Carmel Marina Corporation for solid waste hauling fees; and
b. Consider any objections or protests of landowners liable to be assessed for delinquent fees, as indicated in the report;
c. Adopt a resolution to:
i. Confirm the report of delinquent solid waste hauling fees for the unincorporated area as identified in the “Report of 2025 Delinquent Waste Hauling Fees in the Unincorporated Area” from USA Waste of California, Inc. DBA Carmel Marina Corporation; and
ii. Authorize the delinquent solid waste hauling fees, as set forth in the confirmed report and following conclusion of the dispute resolution process, to constitute special assessments against the respective parcels of land to be collected at the same time and in the same manner as ordinary County ad valorem property taxes are collected; and
d. Authorize the Clerk of the Board to file a certified copy of the report with the Auditor-Controller.

RECOMMENDATION:
It is recommended that the County of Monterey Board of Supervisors:
Set a public hearing for June 23, 2026, at 1:30 p.m. to:
a. Accept the report of delinquent fees, as indicated in the “Report of 2025 Delinquent Waste Hauling Fees in the Unincorporated Area” from USA Waste of California, Inc. DBA Carmel Marina Corporation for solid waste hauling fees; and
b. Consider any objections or protests of landowners liable to be assessed for delinquent fees, as indicated in the report;
c. Adopt a resolution to:
i. Confirm the report of delinquent solid waste hauling fees for the unincorporated area as identified in the “Report of 2025 Delinquent Waste Hauling Fees in the Unincorporated Area” from USA Waste of California, Inc. DBA Carmel Marina Corporation; and
ii. Authorize the delinquent solid waste hauling fees, as set forth in the confirmed report and following conclusion of the dispute resolution process, to constitute special assessments against the respective parcels of land to be collected at the same time and in the same manner as ordinary County ad valorem property taxes are collected; and
d. Authorize the Clerk of the Board to file a certified copy of the report with the Auditor-Controller.
SUMMARY:
Under the current Unified Franchise Agreement (UFA) between USA Waste of California, Inc., DBA Carmel Marina Corporation (Waste Management), and the County of Monterey for the exclusive collection of solid waste and recyclables in the unincorporated areas of the County, delinquent waste hauling fees are collected as special assessments against the property to recover unpaid amounts. These special assessments will be processed through the County’s public hearing procedure in accordance with California Government Code § 25831 to consider adding the charges to property tax assessments.
DISCUSSION:
On December 3, 2024, the Board of Supervisors of the County of Monterey approved a new UFA with Waste Management for waste hauling services in the unincorporated areas of the County. A key component of the new agreement was to remove bad debt attributed to delinquent accounts from being included in the rate structure and to instead utilize a special assessment against the property to collect those unpaid amounts.
A dispute resolution process has been established by the UFA franchise holder Waste Management. Waste Management’s dispute resolution process will be completed prior to the special assessment for delinquent accounts is applied. Notices of delinquent accounts requesting payment were mailed by Waste Management to account holders, as well as property owners of record, in the months of January, February, March and April of 2026. The notices included the amount past due, payment options, the contact information for Waste Management, and a payment deadline of July 25, 2026. The public hearing authorizes the inclusion of unpaid delinquent accounts in the anticipated delinquency list.
It is requested that the Board of Supervisors set a public hearing on June 23, 2026, at 1:30 p.m. to receive comments, objections, and testimony to consider approving delinquent accounts be added as a special assessment for delinquent accounts against the corresponding property to collect those unpaid amounts.

It also supports the following of the ten essential public health services, specifically: Enforce laws and regulations that protect health and ensure safety.
OTHER AGENCY INVOLVEMENT/COMMITTEE ACTIONS:
Waste Management, the Office of the County Counsel, the Auditor-Controller’s Office, and the Assessor-Clerk-Recorder’s Office concur with this recommendation.
FINANCING:
Any incidental costs are funded through the Environmental Health Bureau’s Fiscal Year 2025-26 Adopted Budget. There is no General Fund Contribution resulting from this Board action. Waste Management will continue to remit franchise fees, calculated at ten percent (10%) of collected revenue, to the General Fund as outlined in the UFA at section 11.16.1 Franchise Fee.
BOARD OF SUPERVISORS STRATEGIC PLAN GOALS:
The County supports a solid waste system that is environmentally responsible and maintains stable, mandatory solid waste collection services that protect public health in compliance with Monterey County Code Title 10 - Health and Safety, Chapter 10.41 - Solid Waste Collection and Disposal, Sections 10.41.030(A) and (B). Delinquent refuse service accounts as special assessments promote fiscal sustainability and enhance accountability in County operations.
