Title

Adopt a resolution that orders a general election consolidated with the November 8, 2022 statewide election on the questions of:

a. Shall the East Garrison Community Services District have an elected Board of Directors; and

b. If the East Garrison Services District shall have a directly elected Board of Directors, which 5 candidates shall be elected to serve.

RECOMMENDATION:

It is recommended that the Board of Supervisors of the County of Monterey adopt a resolution that orders a general election consolidated with the November 8, 2022 statewide election on the questions of:

a. Shall the East Garrison Community Services District have an elected Board of Directors; and

b. If the East Garrison Services District shall have a directly elected Board of Directors, which 5 candidates shall be elected to serve.

 

SUMMARY/DISCUSSION:

On March 1, 2022, the East Garrison Community Services District (EGCSD) Board of Directors adopted Resolution No. 22-108 which: a) requested approval of the Board of Supervisors of the County of Monterey to consolidate elections of an independent East Garrison Community Services District Board of Directors with statewide general elections; b) requested an election date of November 8, 2022; and c) authorized reimbursement to the County of Monterey Elections Department for rendered services associated with the conduct of the November 8, 2022 election as required by Elections Code Section 10002. This report is to recommend that the Board of Supervisors formally approve these requests by the EGCSD Board of Directors by formally adopting the resolution provided in Attachment A.

 

Pursuant to Elections Code Section 10404(c), following adoption of Resolution No. 22-108 by the EGCSD Board of Directors, the Clerk of the Board notified all districts located in the county of the receipt of the resolution to consolidate and requested input from each district on the effect of consolidation. No comments were received in response to that notification. Pursuant to Elections Code Sections 10404(d) and (e), the Elections Department prepared an impact analysis of the proposed consolidation, including the cost-effectiveness of the proposed consolidation. That analysis is provided in Attachment B.

 

OTHER AGENCY INVOLVEMENT:

County Counsel and the Election Department reviewed and approved the proposed resolution. The EGCSD Advisory Committee expressed its preference for an election in November 2022, and the EGCSD Board of Directors requested Monterey County Board of Supervisors’ approval to consolidate elections of an independent EGCSD Board of Directors with statewide general elections and to set an election date of November 8, 2022. These actions are consistent with the Board of Supervisors’ prior direction to take the necessary procedural steps to hold an election for independence in November 2022.

 

FINANCING:

The Elections Department will incur costs for services provided to conduct the November 8, 2022 election. The EGCSD will reimburse the Elections Department for all costs associated with conducting the proposed election. There are sufficient funds available in the uncommitted fund balance for EGCSD, Fund 181, to reimburse election costs.  

 

BOARD OF SUPERVISORS STRATEGIC INITIATIVES:

Holding an election to determine if EGCSD shall have an independently elected Board of Directors supports the Board of Supervisors’ Strategic Initiatives for Administration due to an election being required by law and therefore supports the administration of government functions.
