a. Approve and authorize the Director of Health Services or designee to execute Renewal and Amendment No. 2 to the Data Use and Service Agreement with the University of Pittsburgh of the Commonwealth System of Higher Education to continue providing access to the National Retail Data Monitor (NRDM), a public health surveillance tool that collects and analyzes over-the-counter drug sales to identify disease outbreaks and extend the term for an additional year, for a new term from April 12, 2024 to April 11, 2026 adding $1,704 for a total contract not to exceed the amount of $3,223; and
b. Authorize the Contracts and Purchasing Officer or their designee to sign future amendments to the Agreement provided that these amendments do not substantially change the Scope of Services, and the total amount of the amendments does not exceed the Contracts and Purchasing Officer’s signing authority amount of $200,000, with approval from the Office of the County Counsel.

RECOMMENDATION:
It is recommended that the County of Monterey Board of Supervisors:
a. Approve and authorize the Director of Health Services or designee to execute Renewal and Amendment No. 2 to the Data Use and Service Agreement with the University of Pittsburgh of the Commonwealth System of Higher Education to continue providing access to the National Retail Data Monitor (NRDM), a public health surveillance tool that collects and analyzes over-the-counter drug sales to identify disease outbreaks and extend the term for an additional year, for a new term from April 12, 2024 to April 11, 2026 adding $1,704 for a total contract not to exceed the amount of $3,223; and
b. Authorize the Contracts and Purchasing Officer or their designee to sign future amendments to the Agreement provided that these amendments do not substantially change the Scope of Services, and the total amount of the amendments does not exceed the Contracts and Purchasing Officer’s signing authority amount of $200,000, with approval from the Office of the County Counsel.
SUMMARY DISCUSSION:
The National Retail Data Monitor (NRDM) collects and analyzes de-identified sales data of select over-the-counter products from national and large regional retail pharmacies. The data is used to provide situational awareness and aid in identifying infectious disease outbreaks in the community.
The University of Pittsburgh offers annual subscription access to NRDM data from 37 contributing retail stores in Monterey County at the current rate of $46.04 per store. Access to the NRDM platform and data will be limited to staff in the Public Health Epidemiology and Surveillance Unit to support infectious disease outbreak investigation and surveillance activities.
The Amendment No. 1 to the Agreement was executed on July 19, 2024, to amend the deliverables, with no increase in cost or changes to the terms. The Health Department has a continued need for services under the Agreement beyond the expiration date of April 11, 2025. Although the Health Department drafted an amendment prior to the Agreement’s expiration date, negotiations with the Contractor on additional terms needed to reach an agreement prolonged the process and resulted in the expiration of the Agreement.
This work supports the County of Monterey Health Department 2025-2028 Strategic Plan Goals: 1. Build community power and partners’ capacity to increase equity and improve health; and 4. Deepen organizational effectiveness and support long-term sustainability. It also supports four of the ten essential public health services, specifically: 2. Investigate, diagnose, and address health problems and hazards affecting the population, and 7. Assure an effective system that enables equitable access to the individual services and care needed to be healthy, and 9. Improve and innovate public health functions through ongoing evaluation, research, and continuous quality improvement, and 10. Build and maintain a strong organizational infrastructure of public health.
OTHER AGENCY INVOLVEMENT:
The Office of County Counsel and Auditor-Controller have reviewed and approved this Agreement as to legal form and fiscal provisions, respectively.
FINANCING:
The contract in the amount of $3,223 is funded 100% by the grant Epidemiology and Laboratory Capacity in FY 2023-2024 and FY 2024-2025. FY 2025-2026 is funded by Health Realignment. Appropriations for this agreement are included in the Health Department’s (HEA003-8124) FY2024-25 Adopted Budget and in the FY 2025-2026 Proposed Budget .
