a. Approve and Authorize the Contracts/Purchasing Officer to execute a Renewal of Lease Agreement A-3314 on a month to month basis between the County and Rajendra M. and Renu R. Vakhara for approximately 1,300 square feet of space located at 387 Blohm Avenue, Aromas, California, for use by the Monterey County Free Libraries, Aromas Branch;
b. Direct the Auditor-Controller to make lease payments of $1,500.00 per month, retroactively effective July 1, 2017, and in accordance with the terms of the Renewal of Lease Agreement.

RECOMMENDATION:
a. Approve and Authorize the Contracts/Purchasing Officer to execute a Renewal of Lease Agreement A-3314 on a month to month basis between the County and Rajendra M and Renu R. Vakhara for approximately 1,300 square feet of space located at 387 Blohm Avenue, Aromas, California, for use by the Monterey County Free Libraries, Aromas Branch;
b. Direct the Auditor-Controller to make lease payments of $1,500.00 per month, retroactively effective July 1, 2017, and in accordance with the terms of the Renewal of Lease Agreement.
SUMMARY/DISCUSSION:
The Monterey County Free Libraries (MCFL), Aromas Branch occupies approximately 1,300 square feet of space at 387 Blohm Avenue, Aromas, California pursuant to Lease Agreement A-3314 dated July 14, 1981 (originally 770 square feet was rented for $60 per month). Said lease was amended on July 1, 1982, October 17, 1984, July 9, 2002 and March 11, 2004 to extend the term, increase the space, increase the monthly rental amount, and to reflect changes in ownership interests. The subject lease has been in holdover status since June 30, 2006 and MCFL has continued to occupy the space on a month to month basis for $200 rent per month. MCFL desires to remain at this location pursuant to the proposed Renewal of Lease Agreement A-3314 on a month to month basis until MCFL is successful in finding a different location that will meet its operational needs. Rent has been negotiated to $1,500 per month and is to be retroactively effective as of July 1, 2017.
The proposed Renewal of Lease Agreement provides for the following terms:
1) Said Lease Agreement is hereby renewed on a month-to month basis subject to termination upon thirty (30) days written notice by either party.
2) Effective July 1, 2017, the monthly rent shall be One Thousand Five Hundred Dollars ($1,500.00).
3) Monthly rent paid by LESSEE to LESSOR shall include electrical, natural gas, and water for the Premises.
4) All notices to LESSEE shall be addressed to County of Monterey, c/o Real Property Specialist, 1441 Schilling Place, South Building, 2nd Floor, Salinas, California 93901.
5) All notices to LESSOR shall be addressed to Rajendra M. and Renu R. Vakharia, P.O. Box 577, Aromas, California 95004.
6) All other terms and conditions of said Lease Agreement shall remain the same.
The MCFL Director and staff are currently seeking possible alternate future locations for the library.
Annual visitors to the Aromas Library average about five thousand patrons. Patrons of this library are dependent of the library services. MCFL recommends the continuation of library services at this location until another location is secured. The community of Aromas and nearby communities depend on the continuity of library services. The Friends of the Aromas Library are active and vocal in their support of the Aromas and nearby communities’ needs and desires to have a local library.
OTHER AGENCY INVOLVEMENT:
The Resource Management Agency, Administrative Services facilitated the development of the Renewal of Lease Agreement, and assisted with the development of this report. The Office of the County Counsel has reviewed and approved the proposed Renewal of Lease Agreement as to form and legality.
FINANCING:
There is no additional impact to the General Fund. Sufficient funds are available in the FY 2017-18 Monterey County Free Libraries approved budget, Fund 003, Unit 6110 to accommodate the increase in rent. The ongoing occupation of the leased premises and future renewal of the Lease Agreement will be assessed on a month to month basis until another location is secured.
