a. Approve and authorize execution of Amendment No. 3 to Standard Agreement with N. Rex Awalt Corporation dba Aqua Engineering to continue to provide on-call maintenance and repair services for water and sanitation sewer systems, booster pump systems, backflow preventers, water quality testing and other utility system related services, to increase the not to exceed amount by $500,000 for a total amount not to exceed $700,000 and to extend the term for an additional five years for a revised term of January 5, 2022 to January 4, 2031; and
b. Authorize the Contracts & Purchasing Officer or their designee to execute Amendment No. 3 to the Standard Agreement.

RECOMMENDATION:
a. Approve and authorize execution of Amendment No. 3 to Standard Agreement with N. Rex Awalt Corporation dba Aqua Engineering to continue to provide on-call maintenance and repair services for water and sanitation sewer systems, booster pump systems, backflow preventers, water quality testing and other utility system related services, to increase the not to exceed amount by $500,000, for a total amount not to exceed $700,000 and to extend the term for an additional five years for a revised term of January 5, 2022 to January 4, 2031; and
b. Authorize the Contracts & Purchasing Officer or their designee to execute Amendment No. 3 to the Standard Agreement.
SUMMARY/DISCUSSION:
The Department of Public Works, Facilities and Parks established an on-call agreement with N. Rex Awalt Corporation dba Aqua Engineering (Awalt) to provide on-call maintenance and repair services for water and sanitation sewer systems, booster pump systems, backflow preventers, water quality testing and other utility system related services in and around the County of Monterey Parks, including Lake Nacimiento and Lake San Antonio. The water systems require regular maintenance and repair. The extensive systems require a degree of historical knowledge to provide efficient services. Awalt is familiar with these systems. The County has successfully worked with Awalt through the term of their Standard Agreement (SA).
A Standard Agreement with a not to exceed amount of $100,000 was executed on January 18, 2022 with a term from January 5, 2022 through January 4, 2025 (Attachment A). Amendment No. 1 to increase the total not to exceed amount to $200,000 with no changes to the term was executed on August 28, 2024 (Attachment B). Amendment No. 2 to extend the term for an additional one (1) year term from January 5, 2022 to January 4, 2026 , with no increase to the total not to exceed amount was executed on January 7, 2025 (Attachment C).
Additional time and funding is required to allow Awalt to continue to provide these services. Having the ability to utilize on-call services provides the needed support to the Parks operations to ensure the systems are repaired and maintained. Staff requests the Board of Supervisors approve and authorize the Contracts & Purchasing Officer or their designee to execute the proposed Amendment No. 3 to the Agreement (Attachment D) for the amended not to exceed amount of $500,000 for an amended total not to exceed amount of $700,000 and to extend the Agreement for an additional five years, for a revised term of January 5, 2022 to January 4, 2031 due to the ongoing operational need to continue to procure on-call support from Awalt.
OTHER AGENCY INVOLVEMENT:
The Office of the County Counsel and the Auditor-Controller’s Office have reviewed and approved Amendment No. 3 as to form, and fiscal provisions, respectively.
FINANCING:
Services provided by the Contractor will be reimbursed from the respective funding source. Costs associated with services provided by this Contractor and funding will be contained within the approved budget allocations for each Fiscal Year for Lake Nacimiento, Fund 452, Appropriation Unit PFP060 and County Parks, General Fund 001, Appropriation Unit PFP058.
BOARD OF SUPERVISORS STRATEGIC INITIATIVES:
Having the ability to utilize this on-call service provider is needed to support the Parks operations and to help ensure the systems are repaired and maintained which is critical from a health and safety perspective.
