RECOMMENDATION:
It is recommended that the Board of Supervisors:
 
a. Approve the addition of the Rico Street Sidewalk Improvements, Project No. 1572, to the approved Work Plan for Fiscal Year 2014-15;
 
b. Approve an increase estimated revenues of $100,000 and appropriations in the amount of $181,676 in the FY 2014-15 Adopted Budget for the Construction Unit 002-3000-8195-RMA0112 (4/5th vote required); and
 
c. Authorize the Auditor-Controller to amend the FY 2014-15 adopted budget, for the Construction Unit 8195, Fund 002, Appropriation Unit RMA012 to increase estimated revenues by $100,000 and appropriations in the amount of $181,676, where uncommitted fund balance of $81,676 is the financing source to balance the appropriation increase for the Rico Street Sidewalk Improvements Project (4/5 vote required).
 
SUMMARY/DISCUSSION:
The Rico Street Sidewalk Improvements project was anticipated to be constructed in Fiscal Year (FY) 2013-14, due to design and right-of-way challenges with Caltrans the project was delayed to FY 2014-15.  Therefore, the department requests the project be included in the FY 2014-15 Work Plan and Adopted Budget.  
 
The project was awarded $100,000 in Transportation Livable Communities (TLC) grant funds (Regional Surface Transportation Program (RSTP) Competitive Grant) by the Transportation Agency for Monterey County (TAMC) Board on January 22, 2014, and the Director of Public Works approved $81,676 from Gas Tax funds (Road Fund) to fully fund the project.
 
The project consists of the installation of new curb, gutter, sidewalk, drainage, driveways, Americans with Disabilities Act (ADA) ramps, grinding and paving the roadway, and relocating signs and a utility pole along Rico Street between Merritt Street and McDougall Street in the community of Castroville.
 
On January 28, 2014 a California Environmental Quality Act (CEQA) Notice of Exemption was filed.  The project was determined to be categorically exempt from the CEQA, according to Section 15301(c) Existing Facilities, Class 1, because it involves the repair, maintenance or minor alteration of existing streets, sidewalks, gutter, which includes road grading for the purpose of public safety.
 
A Job Order Contract proposal from The Don Chapin Company, Inc. was approved on August 1, 2014, and a Notice to Proceed will be issued upon approval by the Board of Supervisors.
 
OTHER AGENCY INVOLVEMENT:
The Resource Management Agency-Public Works coordinated with TAMC on the approval of TLC funds for the project.  Additionally, the project scope was coordinated with the Castroville Community Services District.  The Office of the County Counsel and Risk Management have reviewed the RSTP Master Agreement as to form.  On May 20, 2014, the Board of Supervisors approved the Master Agreement between TAMC and the County for RSTP Funds for County projects.  This report was presented to the Capital Improvement Committee on October 13, 2014 and to the Budget Committee on October 29, 2014.
 
FINANCING:
There is no impact to the General Fund.  This project was not included in the FY 2014-15 Work Plan or Adopted Budget.  The total cost of the project is $181,876.  It is fully funded with a $100,000 TLC grant from TAMC and $81,676 from uncommitted fund balance in the Road Fund.  The recommended action adds the Rico Street Sidewalk Improvements Project, Project 1572, to the Board Approved FY 2014-15 Work Plan; increases the FY 2014-15 appropriations in Fund 002-3000-8195-RMA012 by $181,676, which will be offset with uncommitted fund balance in the Road Fund; and authorizes the Auditor-Controller to incorporate the approved modification in the FY 2014-15 Budget.
