a. Approve retroactively a Renewal and Amendment No. 4 to Agreement No. A-14785 with Regional Government Services Authority (RGS) to extend the term of the Agreement one year to June 30, 2023, with a retroactive start date of June 30, 2022, and to update the Scope of Work to enable RGS to provide optional and as-requested services required to wind up the Fort Ord Reuse Authority’s (FORA’s) business affairs with no increase in the not to exceed amount of $200,000;
b. Authorize the County Administrative Officer to execute Renewal and Amendment No. 4 to Agreement No. A-14785 and future amendments to the Agreement where the amendments do not significantly alter the scope of work or increase the approved Agreement amount by more than ten percent (10%).

RECOMMENDATION:
It is recommended that the Board of Supervisors:
a. Approve retroactively a Renewal and Amendment No. 4 to Agreement No. A-14785 with Regional Government Services Authority (RGS) to extend the term of the Agreement one year to June 30, 2023, with a retroactive start date of June 30, 2022, and to update the Scope of Work to enable RGS to provide optional and as-requested services required to wind up the Fort Ord Reuse Authority’s (FORA’s) business affairs with no increase in the not to exceed amount of $200,000;
b. Authorize the County Administrative Officer to execute Renewal and Amendment No. 4 to Agreement No. A-14785 and future amendments to the Agreement where the amendments do not significantly alter the scope of work or increase the approved Agreement amount by more than ten percent (10%).
SUMMARY/DISCUSSION:
On June 23, 2020, the Board of Supervisors authorized the County Administrative Officer to approve an agreement with the Fort Ord Reuse Authority (FORA), Regional Government Services Authority (RGS), and the County of Monterey (County) for RGS to provide administrative and fiscal services related to winding up FORA’s business affairs immediately prior to and following FORA’s dissolution. FORA, RGS, and the County entered into Agreement No. A-14785 effective June 29, 2020 (Agreement).
RGS has completed the work under the Agreement; however, additional time is needed to complete optional and as-requested services related to winding up FORA’s business affairs. Since FORA’s dissolution, unresolved deferred compensation and health reimbursement account administration were discovered by RGS and the County FORA wind-up team. These optional services will be added to the Scope of Work of the Agreement through Renewal and Amendment No. 4. For RGS to continue to provide services, it is necessary to extend the Agreement by one (1) year to June 30, 2023. There is no increase to the Agreement amount of $200,000.
OTHER AGENCY INVOLVEMENT:
The Office of the County Counsel and the Auditor-Controller’s Office have reviewed and approved Renewal and Amendment No. 4 as to form and legality, and fiscal provisions, respectively.
FINANCING:
Costs associated with this extension and staff time to administer the agreement are paid from the FORA Dissolution Funds in Fund 511 where the estimated available funding is $1,593,810.
BOARD OF SUPERVISORS STRATEGIC INITIATIVES:
The recommended action complies with the Board of Supervisors’ Strategic Initiatives for Economic Development and Administration by facilitating the wind up of FORA’s business affairs.
