a. Approve and authorize the Director of the Emergency Communications Department to sign an agreement between the County of Monterey and DATAMARK, a division of Michael Baker International, Inc. which includes nonstandard mutual indemnification and liability terms, for a term of five years beginning upon the date of execution, for an amount not to exceed $154,250, to provide Geographical Information Systems (GIS) mapping software;
b. Authorize the Director of the Emergency Communications Department to sign up to three amendments to this Agreement where the total amendments do not exceed 10% ($15,425) of the original agreement amount and do not significantly change the scope of work;
c. Approve and authorize the Director of the Emergency Communications Department to sign a Scope of Work with DATAMARK, a division of Michael Baker International, Inc., through cooperative purchasing agreement H-GAC Buy 20-00525, with a term of five years for an amount not to exceed $73,833 to purchase Geographical Information Systems (GIS) services; and
d. Authorize the Director of the Emergency Communications Department to sign up to three amendments to this Scope of Work where the total Amendments do not exceed 10% ($7,383) of the original agreement amount and do not significantly change the scope of work.

RECOMMENDATION:
It is recommended that the Board of Supervisors:
a. Approve and authorize the Director of the Emergency Communications Department to sign an agreement between the County of Monterey and DATAMARK, a division of Michael Baker International, Inc. which includes nonstandard mutual indemnification and liability terms, for a term of five years beginning upon the date of execution, for an amount not to exceed $154,250, to provide Geographical Information Systems (GIS) mapping software;

c. Approve and authorize the Director of the Emergency Communications Department to sign a Scope of Work with DATAMARK, a division of Michael Baker International, Inc., through cooperative purchasing agreement H-GAC Buy 20-00525, with a term of five years for an amount not to exceed $73,833 to purchase Geographical Information Systems (GIS) services; and
d. Authorize the Director of the Emergency Communications Department to sign up to three amendments to this Scope of Work where the total Amendments do not exceed 10% ($7,383) of the original agreement amount and do not significantly change the scope of work.
SUMMARY/DISCUSSION:
The Monterey County Emergency Communications Department (ECD) is a consolidated public safety answer point and dispatch facility serving 28 law enforcement, fire protection, and emergency medical services (EMS) response agencies throughout Monterey County. Calls for service are dispatched through the ECD’s Computer Aided Dispatch (CAD) system which determines the correct agency response through a Geographical Information System (GIS) driven mapping system within the CAD.
This mapping system contains a street centerline, address points, and law, fire and EMS response zone polygons for the entire County of Monterey. This map determines which agency responds and provides routing for emergency response. The map also includes other information pertinent to emergency dispatch such as the location of schools and fire hydrants.
This Agreement and Scope of Work are for the purchase of software and associated services that will allow the Department to make changes to the map and deploy them to the CAD. The software agreement covers the hosted software platform, cloud storage, and database setup. This software agreement is priced under the terms of CMAS Agreement number 3-19-70-2364D which was awarded through competitive solicitation.
The Scope of Work purchases setup of the automated map roll process from the GIS software into the CAD and support from the vendors GIS specialists. This scope of work is generated through the pricing, terms and conditions of the H-GAC cooperative agreement number 20-00525 which was awarded to the vendor through competitive solicitation.
OTHER AGENCY INVOLVEMENT:
County Counsel has approved this Agreement and Statement of Work as to legal form. The Auditor-Controller, Information Technology Department, and Contracts/Purchasing have reviewed and approved this Agreement and this Statement of Work. Risk Management has reviewed and approved the nonstandard liability and indemnification in this Agreement with approval of this Board.
FINANCING:
Up to $57,477 will be paid in FY2022/23 and sufficient appropriations and estimated revenues are included in 028-8507-EME004 in the FY2022/23 Adopted Budget. Costs for future years will be requested through the annual budget process.
BOARD OF SUPERVISORS STRATEGIC INITIATIVES:
This purchase correlates to the Board’s Public Safety Strategic Initiative by allowing the Department of Emergency Communications maintain an accurate map for public safety dispatching.
