a. Approve Professional Services Agreement with Benchmark Land Use Group, Inc., dba Benchmark Resources for State of California Surface Mining and Reclamation Act annual inspection services (RFP No. 10761) for a total amount not to exceed $311,898 for a term of August 24, 2021 to July 31, 2024 with the option to extend the term for two additional one-year periods; and
b. Authorize the Contracts/Purchasing Officer or Contracts/Purchasing Supervisor to execute the Professional Services Agreement and future amendments to the Professional Services Agreement where the amendments do not significantly alter the scope of work or change the approved agreement amount by more than ten percent (10%).

RECOMMENDATION:
It is recommended that the Board of Supervisors:
a. Approve Professional Services Agreement with Benchmark Land Use Group, Inc., dba Benchmark Resources for State of California Surface Mining and Reclamation Act annual inspection services (RFP No. 10761) for a total amount not to exceed $311,898 for a term of August 24, 2021 to July 31, 2024 with the option to extend the term for two additional one-year periods; and
b. Authorize the Contracts/Purchasing Officer or Contracts/Purchasing Supervisor to execute the Professional Services Agreement and future amendments to the Professional Services Agreement where the amendments do not significantly alter the scope of work or change the approved agreement amount by more than ten percent (10%).
SUMMARY/DISCUSSION:
The Professional Services Agreement (PSA) procures State of California Surface Mining and Reclamation Act (SMARA) annual inspection services for the County of Monterey Housing and Community Development Department (HCD) (Request for Proposal No. 10761) in an amount not to exceed $311,898 for a term of August 24, 2021 to July 31, 2024. There are currently fourteen mine operations in the County of Monterey. This PSA will procure annual mine inspections and condition compliance review as required by SMARA for three years with an option to extend the term for two additional one-year periods. The PSA also allows for Benchmark Resources to assist the County with preparation of closure reports and submittal packages to the Department of Mine Reclamation (DMR) of up to three mines. Additional costs may be incurred if a mine’s reclamation plan requires updating.
Benchmark Land Use Group, Inc., dba Benchmark Resources was selected to provide these services through a competitive selection process in accordance with County policies and State laws.
OTHER AGENCY INVOLVEMENT:
The Office of the County Counsel-Risk Management and Auditor-Controller’s Office have reviewed and approved this PSA as to form and legality, and fiscal provisions, respectively.
FINANCING:
These services are funded by Surface Mine Permit Fees and are included in the annual budget for the HCD Unit 8543 Appropriation Unit HCD002.

The recommended action allows for SMARA inspections to ensure that mine operators are compliant with County policies and State laws and supports the Board of Supervisors’ Strategic Initiative as indicated below:
