a. Approve and authorize the County Purchasing Agent or designee to sign Amendment No. 2 to the Agreement with West Publishing Corporation in the amount of $46,896 for a total not to exceed amount of $71,396 for West CLEAR PRO Gov Law Enforcement Investigator Plus with Gateway Enterprise PRO for the period from October 1, 2020 through June 30, 2029;
b. Accept non-standard contract provisions as recommended by the Chief Probation Officer; and
c. Authorize the County Purchasing Agent or designee and Chief Probation Officer to sign and execute up to three future amendments and the appropriate documents and verifications when required to the Agreement that do not exceed 10% ($7,139) with similar non-standard language provisions for a total aggregate contract amount not to exceed $78,535.

RECOMMENDATION:
It is recommended that the Board of Supervisors:
a. Approve and authorize the County Purchasing Agent or designee to sign Amendment No. 2 to the Agreement with West Publishing Corporation in the amount of $46,896 for a total not to exceed amount of $71,396 for West CLEAR PRO Gov Law Enforcement Investigator Plus with Gateway Enterprise PRO for the period from October 1, 2020 through June 30, 2029;
b. Accept non-standard contract provisions as recommended by the Chief Probation Officer; and
c. SUMMARY
The Probation Department recommends the approval of Amendment No. 2 to the non-standard Agreement with West Publishing Corporation for the West CLEAR PRO Gov Law Enforcement Investigator Plus with Gateway Enterprise PRO products. The amendment increases the amount of the Agreement by $46,896 for a total not to exceed amount of $71,396 and extends the term for an additional two years and nine months, through June 30, 2029. The amendment also expands the search tools and capabilities available through the West CLEAR PRO Gov Law Enforcement Investigator Plus with Gateway Enterprise PRO software. This software provides online research services including, but not limited to, reverse phone data, consumer and credit bureau data, motor vehicle registration data, graphical display, news, map analytics, and company family tree. Juvenile Probation will continue using this program to locate family members for Foster Care Placement youth. Additionally, Adult Probation will use the expanded program to strengthen supervision efforts and ensure the integrity of the warrant processes.
DISCUSSION:
The subscription to West CLEAR PRO Gov Law Enforcement Investigator Plus software with Gateway Enterprise PRO provides a comprehensive dashboard interface, news content, public records, publicly available information, and proprietary records on persons and businesses. These tools will be used in assisting Probation with locating family members for Foster Care Placement and also in locating individuals, receiving timely arrest notifications, and generating alerts for high-profile clients. This software supports probation’s responsibilities and goals related to family finding efforts as outlined in California Assembly Bill 403 and the State’s Continuum of Care Reform legislation for foster care, as well as the processing of adult offenders and Probation’s broader commitment to public safety.
The proposed amendment will expand and extend the investigative research and tools software of the West CLEAR PRO Gov Law Enforcement Investigator Plus software with the added Gateway Enterprise PRO. It will also extend the term of the Agreement for two years and nine months, through June 30, 2029. Additionally, the proposed amendment contains non-standard indemnification and liability provisions as well as non-standard payment terms. These non-standard provisions are an industry-wide accepted standard although not County standard.
OTHER AGENCY INVOLVEMENT/COMMITTEE ACTIONS:
County Counsel has reviewed the amendment, including the non-standard terms, and approves it as to form. County Risk Management does not approve the amendment due to the presence of non-standard indemnity and liability provisions. The Auditor Controller’s Office has reviewed the amendment and does not approve the fiscal aspects of the amendment due to payment terms that are non-standard for the County. Probation recommends that the Board approve the amendment, including the non-standard payment terms, as the Agreement has been in place since 2020 with no issues reported regarding the vendor’s performance or billing practices.
FINANCING:
Funding for the software subscription service is included in Probation’s FY 2026-27 Adopted Budget, for Appropriation Unit PRO001, Unit 8165 and Unit 8166. Subsequent fiscal years will be incorporated into the annual budget approval process. The recommended action results in no additional cost to the County General Fund.
