RECOMMENDATION:
It is recommended that the Board of Supervisors:
a.  Adopt the License Agreement with the City of Salinas for the use of the parking lot located at 12 West Market Street and 20-26 Station Place to provide daily parking for jurors and persons responding to juror summons (Exhibit A); and
b.  Authorize the Resource Management Agency Director to sign the License Agreement with the City of Salinas for juror parking at 12 West Market Street and 20-26 Station Place.
 
SUMMARY/DISCUSSION:
The County Resource Management Agency (RMA) has an agreement (as part of the North Wing Transfer Agreement) with the Judicial Council of California Administrative Office of the Courts (AOC) to provide adequate parking for persons responding to juror summons or serving as jurors in the Superior Court located at 240 Church Street in the City of Salinas.   
 
Jurors and persons responding to juror summons are provided parking at the parking lot located at 20-26 Station Place in Salinas (referred to as the AMTRAK  Parking Lot in the North Wing Transfer Agreement).  The parking lot is owned by the City of Salinas and has been used for juror parking based on an informal agreement with the City.  The County provides security guard services at the parking lot as well as shuttle service between the parking lot and the Superior Court.  
 
City and County staff have investigated multiple options for parking and determined that the use of the current parking lot remains the best option to serve the Court's needs (about 120 vehicles at peak period).  RMA and the City of Salinas desire to formalize the parking lot terms of use.   Therefore, City and County staff worked together to draft terms for use for the parking lot, and to clarify the obligations of both parties through a License Agreement (Exhibit A).  
 
Per the License Agreement:
-      City will operate and maintain the parking lot (provide services such as on-going maintenance, garbage collection, landscaping, etc.).  
-      County (RMA) will provide security at the lot during the hours of juror use (between 7:00 a.m. and 6:00 p.m.).  
 
The County (RMA) will continue to provide shuttle service for jurors and prospective jurors.  The term of the License Agreement is for two years; either party has the right to terminate the License Agreement with no less than 60 days written notice.  City and County staff continue to work toward a longer term solution to provide parking near the government center and/or downtown area.  This Agreement is intended to be in place only until adequate parking is available in this area.
 
OTHER AGENCY INVOLVEMENT:
Developing the terms of this Agreement has been a joint effort between staff from the City of Salinas (Economic and Community Development, Public Works) and County of Monterey (RMA Admin/Finance, RMA/Public Works, RMA/Fleet, RMA/Planning).  The Courts have been informed of the proposed License Agreement.  The License Agreement has been reviewed by legal counsel for both the County and the City.  The Salinas City Council is scheduled to hear this matter February 26, 2013.
 
FINANCING:
The license agreement results in no new or additional costs to the County.  The current costs incurred by the County include those associated with the salary and benefits for the shuttle bus driver and security guard services at the parking lot, approximately $178,000 per year.  The Courts contribute $50,000 per year for the shuttle program.  The RMA contributes the remaining $128,078 of the annual costs.  The City of Salinas estimates its operations and maintenance costs of the parking lot to be $16,740.
