RECOMMENDATIONS:

It is recommended that the Board of Supervisors:

a.                     Approve Amendment No. 5 to Professional Services Agreement No. A-12442 with Denise Duffy & Associates, Inc. to continue to provide services associated with completion of an Environmental Impact Report (EIR) for projects located in the Carmel River Lagoon Area and Carmel River Lagoon Restoration and Management Plan (Request for Proposals #2012-CRL-1) for Phases 1 and 2 to extend the expiration date from December 31, 2016 for eighteen (18) additional months through June 30, 2018, for a revised term from April 23, 2013 to June 30, 2018 with no change to the Agreement’s not to exceed total amount of $824,554; and

SUMMARY/DISCUSSION:

Amendment No. 5 to the Professional Services Agreement (PSA) with Denise Duffy & Associates, Inc. (DD&A) will extend the expiration date from December 31, 2016 to June 30, 2018 (beyond the anticipated three (3) year PSA term allowed per RFP #2012-CRL-1 for a total term of five (5) years and approximately three (3) months) with no change to the PSA’s not to exceed total amount of $824,554.  Additional time beyond the original term authorized per the RFP will be required through June 30, 2018 and further extensions may be required on an “as needed” basis to complete all work for this technically complex proposed project, due to the following: 1) expansion of the original PSA’s scope; 2) significant delays and challenges in addressing regulatory agency, community, and technical issues related to the proposed Carmel River Lagoon Area projects; and 3) need to further negotiate a scope with DD&A, after environmental review is complete and a project(s) is selected within the Project area, to allow for completion of permitting requirements.

 

Attachment A provides a summary of the PSA to date.

FINANCING:

There is no impact to the General Fund as a result of this action.  Amendment No. 5 to the PSA allows for an extension of the term for eighteen (18) additional months from December 31, 2016 to June 30, 2018 with no associated dollar amount increase to the PSA and does not change the previously approved increase appropriations and revenue (operating transfer in) by $150,000 for the RMA Facilities Master Plan Projects Fund (RMA015-404-3000-8174) for consulting and permitting costs associated with Carmel Lagoon (EPB/SRPS).
