Approve Amendment No. 1 to Professional Services Agreement No. A-14462, Multi-Year Agreement #3200*4612, with Harris & Associates, Inc. to continue to provide on-call construction management services for projects located in Monterey County, California, Request for Qualifications #10709, to increase the not-to-exceed amount by $3,000,000 for a total amount not-to-exceed $3,750,000 and extend the expiration date for one (1) additional year through July 15, 2023, for a revised term from July 16, 2019 to July 15, 2023, with the option to extend the term for one (1) additional one (1) year period;
b. Approve Amendment No. 1 to Professional Services Agreement No. A-14463, Multi-Year Agreement #3200*4613, with MNS Engineers, Inc. to continue to provide on-call construction management services for projects located in Monterey County, California, Request for Qualifications #10709, to increase the not-to-exceed amount by $2,500,000 for a total amount not-to-exceed $3,250,000 and extend the expiration date for one (1) additional year through July 15, 2023, for a revised term from July 16, 2019 to July 15, 2023, with the option to extend the term for one (1) additional one (1) year period;
c. Approve Amendment No. 1 to Professional Services Agreement No. A-14465, Multi-Year Agreement #3200*4619, with Vali Cooper & Associates, a TRC Company to continue to provide on-call construction management services for projects located in Monterey County, California, Request for Qualifications #10709, to increase the not-to-exceed amount by $1,500,000 for a total amount not-to-exceed $2,250,000 and extend the expiration date for one (1) additional year through July 15, 2023, for a revised term from July 16, 2019 to July 15, 2023, with the option to extend the term for one (1) additional one (1) year period; and
d. Authorize the Contracts/Purchasing Officer or Contracts/Purchasing Supervisor to execute Amendment No. 1 to each Professional Services Agreement and future amendments to each Agreement where the amendments do not significantly alter the scope of work or increase the approved amount of each Agreement.

RECOMMENDATION:
It is recommended that the Board of Supervisors:
a. SUMMARY:
The Department of Public Works, Facilities and Parks (PWFP) has established several on-call Professional Services Agreements (PSAs) for specialized services when County staff requires special expertise or when the volume of work exceeds capacity to manage in a timely manner. On-call PSAs are utilized across PWFP and by other County Departments for specialized expertise in operations, management and specific facility and capital projects. Amendment No. 1 to the PSAs with Harris & Associates, Inc. (A-14462), MNS Engineers, Inc. (A-14463), and Vali Cooper & Associates, a TRC Company (A-14465) would increase the not-to-exceed amount and extend the term of each of the PSAs to provide future on-call construction management services. Construction management services, in general, include the following: professional engineering services required for construction contracts in the public sector, which services include engineering inspection services, material testing and surveying services necessary to verify the project is constructed as specified in the project plans and specifications.
DISCUSSION:
Harris & Associates, Inc., MNS Engineers, Inc., and Vali Cooper & Associates, a TRC Company, along with one (1) other consultant (Quincy Engineering, Inc. (A-14464)) were selected for their expertise and capabilities necessary to provide construction management services for projects located in Monterey County, California under a competitive selection process in accordance with County policies and State and Federal laws under Request for Qualifications (RFQ) #10709.
PWFP has identified a need to increase the not-to-exceed amount of the PSAs with Harris & Associates, Inc., MNS Engineers, Inc., and Vali Cooper & Associates, a TRC Company to continue to provide on-call construction management services to augment the need for services when the volume of work exceeds PWFP’s capacity, and to provide professional specialized construction management expertise that PWFP does not have. Amendment No. 1 to the PSA between the County and Harris & Associates, Inc. will increase the not-to-exceed amount of $750,000 by $3,000,000 for a total amount not-to-exceed $3,750,000. Amendment No. 1 to the PSAs between the County and MNS Engineers, Inc. and Vali Cooper & Associates, a TRC Company will increase the not-to-exceed amount of $750,000 by $2,500,000 for a total amount not-to-exceed $3,250,000 for each PSA. Amendment No. 1 to each PSA will further extend the expiration date from July 15, 2022 for one (1) additional year through July 15, 2023, for a revised term from July 16, 2019 to July 15, 2023, with the option to extend the term for one (1) additional one (1) year period.
Attachments D through F, provided for reference, include PSAs No. A-14462, A-14463, and A-14465. Attachment G provides a summary of each PSA and Attachment H provides a summary of the annual expenditures and balance of each of the PSAs to date.
OTHER AGENCY INVOLVEMENT:
The Office of the County Counsel and the Auditor-Controller’s Office have reviewed and approved each Amendment No. 1 as to form, and fiscal provisions, respectively.
FINANCING:
Funding included with this action is not currently allocated to any specific project. Services provided by each consultant will be budgeted and reimbursed from the respective funding source of each project. Costs associated with services provided by these on-call consultants and funding will be contained within the approved budget allocations for a specific operating unit or contained within the Board of Supervisors approved project budget within Fund 002 Road Fund and Fund 404 Facilities Master Plan Projects.
BOARD OF SUPERVISORS STRATEGIC INITIATIVES:
These on-call services will allow for the planning and development of sustainable, physical infrastructure that improves the quality of life for County residents and supports economic development results, and further provides for adequate County facilities and infrastructure.
