a. Approve an amendment to the current License and Support Agreement of

September 12, 2006, between Decade Software Company, LLC, and Monterey

County to augment the agreement in the amount of $58,034.84 and extend the

Agreement for provision of data management services for an additional one 1)

year term from July 1, 2009 to June 30, 2010;

b. Authorize the Director of Health to sign the amendment; and

c. Authorize the Director of Health to approve future amendments up to five

percent 5%) of the annual amount, which does not significantly alter the scope

of work or result in an increase to net county costs.

Upon motion of Supervisor Parker, seconded by Supervisor Salinas, and carried by those

members present, effective July 21, 2009, the Board hereby:

a. Approved an amendment to the current License and Support Agreement of September 12,

2006, between Decade Software Company, LLC, and Monterey County to augment the

agreement in the amount of $58,034.84 and extend the Agreement for provision of data

management services for an additional one 1) year term from July 1, 2009 to June 30, 2010;

SUBJECT: a. Approve an amendment to the current License and Support Agreement o eptember 12,

DEPARTMENT: Health  Environmental Health Division

RECOMMENDATION:

It is recommended that the Board of Supervisors:

a. Approve an amendment to the current License and Support Agreement of September 12, 2006, between

Decade Software Company, LLC, and Monterey County to augment the agreement in the amount of

$58,034.84 and extend the agreement for provision of data management services for an additional one

1) year term from July 1, 2009 to June 30, 2010;

b. Authorize the Director of Health to sign the amendment; and

c. Authorize the Director of Health to approve future amendments up to five percent 5%) of the annual

amount, which does not significantly alter the scope of work or result in an increase to net county

costs.

SUMMARY:

An existing agreement between Decade Software Company, LLC, and the County provides for enterprise

database software for the Health Department's Environmental Health Division EHD). The proposed

amendment to that agreement would allow EHD to continue using the software for the purposes of billing

Environmental Health customers, reporting data to the State of California, as an aide in tracking staff

efficiency and effectiveness, for providing food facility inspection information to the public on the

internet, and for other database-driven administrative and management needs.

DISCUSSION:

Decade Software has exclusive rights to market the proprietary software, Envision and Press Agent. With

Envision and Press Agent, Decade Software provides data management services for numerous

environmental health programs in California, as well as in other states.

Environmental Health has identified Envision as the product that best suits its needs for billing the

businesses and public entities that Environmental Health regulates, for reporting required data regarding

Environmental Health activities to various State agencies, and for managing its activity records database.

Press Agent coordinates with Envision to provide food facility inspection information to the public on the

internet.

Environmental Health has contracted with Decade Software to use Envision since 1996, and to use Press

Agent since 2008. It is vital that the Environmental Health Division continues to receive these critical

SIGNED BOARD REPORTX��")B�data management services by extending the agreement for an additional one 1) year term from July 1,

2009 to June 30, 2010. The amendment augments the agreement by $58,034.84 for these services during

the extended term. Failure to amend this agreement could result in deterioration of services to the public

and unacceptable risks to public health.

A copy of the current contract and proposed amendment is on file with the Clerk to the Board of

Supervisors.

OTHER AGENCY INVOLVEMENT:

County Counsel has approved the amendment as to form.

FINANCING:

Costs associated with this amendment were budgeted in the FY2009-10 budget. There would be no

change to Net County Cost.
