a. b. Authorize the Director of Public Works, Facilities and Parks to execute the Temporary Construction Easement Agreement, on behalf of the County.

RECOMMENDATION:
It is recommended that the Board of Supervisors:
a. Approve a Temporary Construction Easement Agreement between County of Monterey and CVR HSGE, LLC, a Delaware limited liability company, in the amount of $2000.00, for temporary construction easements over portions of APN 169-091-048 and 416-522-021 for the construction of Robinson Canyon Road Bridge Scour Repair Project, Project No. 3851; and
b. Authorize the Director of Public Works, Facilities and Parks to execute the Temporary Construction Easement Agreement on behalf of the County.
SUMMARY:
Approval of the Temporary Construction Easements Agreement will provide the County of Monterey access over parcels owned by CVR HSGE, LLC (APN 169-091-048 and 416-522-021) to construct the Robinson Canyon Road Bridge Scour Repair Project.
DISCUSSION:
The Public Works, Facilities and Parks Department (PWFP) is proposing the Robinson Canyon Road Bridge Scour Repair Project (Project) to repair the existing two-lane bridge. The Robinson Canyon Bridge crosses the Carmel River and was originally constructed in 1971. The Project is located just south of Carmel Valley Road (0.1 miles south), and approximately eight (8) miles southeast of the City of Carmel. A Caltrans bridge scour review, dated June 22, 2005, identified the Robinson Canyon Road Bridge as scour critical, indicating that the scour would erode the river bottom below the footings of Abutment 1 and Pier 2, and possibly to the pile tip during a major flood event.
PWFP staff has prepared design plans to construct the Project. Temporary construction easements (TCE) are needed from four (4) adjacent properties to access and construct the bridge repairs. Agreements have been previously approved for the following three (3) of the four (4) adjacent properties: Donald E. Vermeil, Trustee of the Vermeil Living Trust Agreement as Amended dated November 6, 1978, Rector, Wardens, and Vestrymen of St. Dunstan’s Parish, and Angee Dee Morriss. Approval of this remaining Agreement with CVR HSGE, LLC, will provide the final TCE necessary to construct the bridge repairs. This TCE Agreement provides the County of Monterey a one-year window (April 2022 through April 2023) to complete the necessary road and bridge repairs to the bridge.
Associated Right of Way Services, Inc. (ARWS) performed the appraisals and conducted the right-of-way negotiations for the properties. The appraisal indicates that the just compensation due as of the valuation date of May 8, 2020 was $2,000 for the property owned by CVR HSGE, LLC.
OTHER AGENCY INVOLVEMENT:
The Office of the County Counsel has reviewed and approved the Agreements to Purchase Temporary Construction Easements as to form and legality.
FINANCING:
The total estimated project cost, including engineering, environmental, right-of-way and construction is $2,596,759. The project is largely funded by the Federal Highway Administration (FHWA) Highway Bridge Program (HBP) in the amount of $ 2,263,499. The Project is also funded by State Funds (Toll Credits) in the amount of $293,260 and local Measure X funds in the amount of $40,000. There are sufficient appropriations adopted in the FY 2020-21 Road Fund 002, Appropriation Unit RMA012 budget to finance the right-of-way phase of the Project.
BOARD OF SUPERVISORS STRATEGIC INITIATIVES:
The Project repairs an existing bridge by placing articulated concrete mat to protect the roadway slope and two (2) existing bridge piers. The recommended action supports the following board of Supervisors’ Strategic Initiative:
