c.  Approve the recommendation of the Director of Health to accept insurance provisions in the Agreement.

RECOMMENDATION:

It is recommended that the Board of Supervisors:

a.  Approve and authorize the Director of Health or the Assistant Director of Health to sign a non-standard Exhibition Agreement with Sand City, in the amount of $125, to participate in the West End Celebration in Sand City on August 28, 2021 through August 29, 2021;

b.  Accept non-standard risk provisions as recommended by Director of Health; and

c.  Approve the recommendation of the Director of Health to accept insurance provisions in the Agreement.

 

SUMMARY/DISCUSSION:

The Monterey County Health Department will attend the Sand City 20th Anniversary West End Celebration on Saturday August 28th from 10am to 6:00 pm and Sunday from 10am to 5:30 pm.  Environment Health, Planning, Evaluation and Policy, and Public Health Bureau will collaborate over the two days to provide information and education to Monterey County residents and visitors.

                     Cannabis Education Program staff will provide materials on illicit cannabis products, drugged driving, and youth cannabis use

                     Planning, Evaluation, and Policy staff will provide information on Medi-Cal eligibility and how to sign up for services

                     Tobacco Control Program staff will provide materials on secondhand smoke, vaping, tobacco retail licensing, and smoke-free housing

                     Environment Health staff will provide information on recycling, hazardous waste such as electronic cigarettes and animal services.

 

The Agreement contains non-standard provisions, namely that the City of Sand carries no insurance to cover any injury or loss at the events, and that the County of Monterey must indemnify the City for any and all claims arising from the event, with exception of damages arising from the sole negligence or willful misconduct of the City.

 

This work supports the Monterey County Health Department 2018-2022 Strategic Plan Initiatives:  1. To empower the community to improve health and 2.  Enhance community health and safety through prevention. It also supports the following of the ten essential public health services, specifically:  3. Inform, educate, and empower people about health issues, and 4. Mobilize community partnerships and action to identify and solve health problems.

 

OTHER AGENCY INVOLVEMENT:

The office of County Counsel and the Auditor-Controller have reviewed and approved this Agreement as to form, and fiscal provisions, respectively.

 

FINANCING:

Appropriations for this Agreement are included in the Health Department’s Public Health Bureau’s (HEA003-8124) Fiscal Year (FY) 2021-22, Adopted Budget.
