Before the Board of Supervisors in and for the
County of Monterey, State of California
Resolution No: 09-358
a. Adopt Resolution to accept Permanent Easement Grant
Deed for roadway and public utility easement and Grant
Deed for well equipment easement and pipeline
easement Easements) from the San Jerardo Housing
Cooperative, Inc. Cooperative); and
b. Authorize the Director of Public Works to execute the
Certificate(s) of Acceptance and Consent to Recordation
for said Easements on behalf of the County.
WHEREAS, The San Jerardo Water System has a history of water quality problems including
high nitrate levels and the presence of 1, 2, 3 Trichloroprane. The system fails to comply with
County standards, which require at least two reliable sources of potable water; and
WHEREAS, On July 18, 2007, a Standard Agreement for a one-million dollar $1,000,000)
Community Development Block Grant CDBG) was entered into between the State of California
Department of Housing and Community Development and Monterey County for a $1,000,000
grant for improvement of water system facilities serving the San Jerardo Cooperative
community; and
WHEREAS, On April 14, 2009, the Board of Supervisors approved submittal of a grant
application under the American Recovery and Reinvestment Act ARRA) for an amount not to
exceed $4,000,000 for the San Jerardo Water System Improvement Project Project); and
WHEREAS, To carry out water system improvements to be financed from these funding
sources, the subject easements are needed on the San Jerardo Cooperative property. These
Easements would allow for the construction of pipeline and water system facility improvements
on the Cooperative property. The proposed action would allow for the acceptance of necessary
easements.
NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors of the County of
Monterey, hereby:
a. Adopted a Resolution to accept Permanent Easement Grant Deed for roadway and public
utility easement and Grant Deed for well equipment easement and pipeline easement
Easements) from the San Jerardo Housing Cooperative, Inc. Cooperative); and
b. Authorized the Director of Public Works to execute the Certificate(s) of Acceptance and
Consent to Recordation for said Easements on behalf of the County.

RECOMMENDATIONS:
It is recommended that the Board of Supervisors:

from the San Jerardo Housing Cooperative, Inc. Cooperative); and
b. Authorize the Director of Public Works to execute the Certificate(s) of Acceptance and
Consent to Recordation for said Easements on behalf of the County.
SUMMARY:
Acceptance of the Permanent Easement Grant Deed and Grant Deed is required for the
construction of water system improvements serving the San Jerardo Cooperative.
DISCUSSION:
The San Jerardo Water System has a history of water quality problems including high nitrate
levels and the presence of 1, 2, 3 Trichloroprane. The system fails to comply with County

OTHER AGENCY INVOLVEMENT:
The Office of the County Counsel has reviewed and approved the Permanent Easement Grant
Deed and the Grant Deed as to form and legality, in consultation with Public Works Engineering
Staff and the County's Real Property Specialist for the San Jerardo Water System Project.

There is no financial impact to the General Fund. The proposed Easements are needed to

We, the San Jerardo Cooperative, Inc., a California Corporation,(Grantors) hereby grants
to the COUNTY of MONTEREY a political subdivision of the State of California,
Grantee), a portion of the real property situated in the County of Monterey, California
described as follows: See Exhibit A" Legal Description, attached hereto and made a
part hereof.
Parcel 1 A" An easement for public utility purposes to construct, maintain, operate,
inspect, repair, replace and remove pipelines, poles, and overhead utility lines as Grantee,
its successors and assigns may from time to time require, in, over, under and upon,
including ingress thereto and egress therefrom that certain real property, in the County of
Monterey, State of California described as: Exhibit A" and depicted on Exhibit B"
attached hereto and made a part hereof.
Grantors also grants to Grantee the right to trim such trees and other foliage and to cut
such roots on said property as may be necessary for the protection of Grantee's facilities.

MONTEREY a political subdivision of the State of California portions of the real
property situated the City of Salinas, Monterey County, California described as follows:

Parcel 2A" an exclusive easement for water service equipment purposes, appurtenances
and incidents hereto, over, under, across, including ingress egress for operation and
