a. b. Authorize the Contracts/Purchasing Officer or Contracts/Purchasing Supervisor to execute Amendment No. 4 to Agreement No. A-12598 and any future amendments to the Agreement where the amendments do not significantly alter the scope of work or increase the approved Agreement amount.

RECOMMENDATION:
It is recommended that the Board of Supervisors:
a. Approve Amendment No. 4 to Agreement No. A-12598 with Lionakis for architectural services related to the Jail Housing Addition Project, Project No. 8819 to increase the not to exceed amount by $200,000 for a total amount not to exceed $5,180,923; and extend the expiration date for three (3) additional months through March 31, 2020; and
b. Authorize the Contracts/Purchasing Officer or Contracts/Purchasing Supervisor to execute Amendment No. 4 to Agreement No. A-12598 and any future amendments to the Agreement where the amendments do not significantly alter the scope of work or increase the approved Agreement amount.
SUMMARY/DISCUSSION:
Lionakis was selected for their professional qualifications and expertise in specialized detention projects necessary to provide architectural services for schematic design through construction services (hereinafter, “services”) for the Jail Housing Addition Project, Project No. 8819 (hereinafter, “Project”) through a competitive selection process in accordance with County policies and State laws under Request for Qualifications (RFQ) No. 10401.
Amendment No. 4 will allow Lionakis to continue to provide architectural services for the Project including a lift station and water softener study for the Project. Amendment No. 4 will increase the total not to exceed amount of $4,980,923 by $200,000 for a total amount not to exceed $5,180,923 and extend the expiration date from December 31, 2019 for three (3) additional months through March 31, 2020, for a revised term from November 18, 2013 to March 31, 2020. This extension provides services through the Jail Housing Project construction completion date of January 31, 2020, with additional time through March 31, 2020 to allow for services during closeout.
Attachment G provides a summary of the Agreement to date. Attachment H provides a summary of the Agreement annual expenditures and balance.
OTHER AGENCY INVOLVEMENT:
The Office of the County Counsel and the Auditor-Controller’s Office have reviewed and approved Amendment No. 4 as to form, and fiscal provisions, respectively.
FINANCING:
Current Project cost projections, including the proposed increase to the Agreement are within the Project budget. The budget includes a contingency of $6,627,700. To date, $1,277,264 remains in the contingency, which is expected to cover costs for additional work related to sewer line lift station and water softener installation. Estimates for this work are pending, but not expected to exceed $1,000,000. In addition, the Contractor recently submitted change order requests to the County in the amount of $1,322,412. If the County accepts some or all of these change orders, additional funding would be required to supplement the Project budget. The total not to exceed amount of the Lionakis Agreement for the Project is $5,180,923. Sufficient appropriations to fund this Amendment No. 4 are available in the FY 2019-20 Adopted Budget for Fund 404, Unit 8174, Appropriations Unit RMA015.
BOARD OF SUPERVISORS STRATEGIC INITIATIVES:
The Agreement with Lionakis, as amended under Amendment No. 4, continues to recognize the exigent need for the services to construct a permanent solution for the Project. The Project is needed to provide a larger facility as the high occupancy count makes it critical, and additionally to assist the County with the State-mandated milestones. The recommended action supports the BOS’ Strategic Initiatives as indicated below:
