Title: a. RECOMMENDATION:
It is recommended that the Board of Supervisors:
a.      Approve and authorize the Director of Health or designee to execute and submit, on behalf of the County of Monterey, all agreements, applications and documents, and any amendments thereto, related to the revised Local Primacy Delegation Agreement and the Grant Funding Agreement for grant funds that will be awarded from the State of California Department of Public Health after the two agreements have been executed;
b.      Authorize the Director of Health or designee to receive grant funds in an amount of $879,000 to implement the purposes specified in the revised Local Primacy Delegation Agreement and the Grant Funding Agreement with the State of California Department of Public Health; and
c.      Authorize the Auditor-Controller to establish a deferred revenue liability sub-Balance Sheet Account (BSA) LPA Trust Fund under BSA 2875 EHB LPA for Environmental Health, effective FY 2013-14.
 
SUMMARY/DISCUSSION:
California Department of Public Health, under the provisions of Section 116330 of the California Health and Safety Code, has previously delegated primacy to 32 local primacy agencies (LPAs) for the regulation of public water systems with 15 to 199 service connections and certain non-community water systems.  LPAs are county environmental health jurisdictions that have applied for and were granted regulatory authority over a portion of the public water systems in their county, and include Monterey County.  The last LPA agreement was executed July 1, 1993.  A new LPA agreement has been developed to clarify issues and update the partnership between Monterey County and the State to assure a healthy water supply for County residents.
 
Grant funds received as a result of signing the new LPA Delegation Agreement are designated specifically for implementation of the agreement and are expected to be expended over multiple fiscal years.  Any funds not expended by the County for LPA activities must be set aside and designated as LPA Trust Funds until eligible expenditures are identified.  If the County spends the funds on non-eligible expenses, the monies are subject to recoupment by the State.
 
This requested Board action would authorize the Auditor-Controller to establish the new trust fund so that it would be available in the County's financial system by the time the County accepts the grant funds.  Health Department staff will coordinate any future request for increase in appropriations and other budget items with the CAO as the need arises, and return to the Board for authorization as appropriate.
 
This work supports the Monterey County Health Department 2011-2015 strategic plan initiatives: 1) Empower the community to improve health through programs, policies, and activities; and 2) Enhance community health and safety by emphasizing prevention. It also supports four of the ten essential public health services, specifically: 2) Diagnose and investigate health problems and health hazards in the community; 3) Inform, educate and empower people about health issues; 4) Mobilize community partnerships and action to identify and solve health problems; and 5) Develop policies and plans that support individual and community health efforts.
 
OTHER AGENCY INVOLVEMENT:
The Auditor-Controller and CAO have participated in the development of, and agree with the recommendation for the establishment of a deferred revenue liability sub-BSA LPA Trust Fund under BSA 2875 EHB LPA for Environmental Health, effective FY 2013-14.  Attachment A - Local Primacy Delegation Agreement is on file with Clerk of the Board. Attachment B - Grant Funding Agreement is on file with Clerk of the Board.
 
FINANCING:
Authorization for the Auditor-Controller to establish a deferred revenue sub-balance sheet account will improve the County's capability to transparently spend the funds on appropriate LPA purposes.
There will be no additional cost to the County General Fund associated with this recommendation.
