a. Authorize the Contracts/Purchasing Officer or designee to execute a retroactive Amendment with the California Forensic Medical Group, Inc. b. Authorize the Contracts and Purchasing Officer or designee to execute one (1) future six (6) month amendment in the amount of  $702,676, for a not to exceed total of $4,132,000 for the JBCT portion of the agreement with a new term ending date of June 30, 2026.

RECOMMENDATION:

It is recommended that the Board of Supervisors:

a. Authorize the Contracts/Purchasing Officer or designee to execute a retroactive Amendment with the California Forensic Medical Group, Inc. (CFMG) Professional Services Agreement A-13814 for the Jail Based Competency Treatment (JBCT) program, in the amount of $3,429,323 for a period covering July 1, 2023, to December 31, 2025; and

b. Authorize the Contracts and Purchasing Officer or designee to execute one (1) future six (6) month amendment in the amount of  $702,676, for a not to exceed total of $4,132,000 for the JBCT portion of the agreement with a new term ending date of June 30, 2026.

 

SUMMARY/DISCUSSION:

On September 10, 2019, the Monterey County Board of Supervisors unanimously approved a contract between the MCSO and the Department of State Hospitals (DSH) to host a regional Jail Based Competency Treatment (JBCT) program aimed at restoring to competency those inmates charged with felonies and found by the courts to be incompetent to stand trial, with board order A-14494.

 

Due to the continued need for beds and program space for inmates found incompetent to stand trial, DSH requested, and the Board approved another contract with DSH on July 21, 2023 (Board Order A-16459).

 

Monterey County Sheriff’s Office (MCSO) has engaged the services of California Forensic Medical Group, Inc. (CFMG) to provide medical and mental health services at the Monterey County Jail for incarcerated persons and to also administer the JBCT program. This amendment is a modification which adds funding for the continuation of the JBCT program through December 31, 2025.

 

The number of incarcerated persons with mental health issues continues to grow. This funding will allow the JBCT program to continue to provide service to incarcerated persons from Monterey, Santa Cruz, and San Benito Counties.

 

The program has proven to be effective in getting incarcerated persons into treatment and restored to competency. The JBCT has a set curriculum, established by the DSH, and administered by CFMG. This curriculum includes classroom environment programming, counseling, and a therapeutic living environment that fosters socialization with other program participants. Where necessary it would also include individual work with program participants.

 

There are currently 13 beds dedicated to the JBCT program.

 

Approval of this board report would allow for the extension of the current CFMG agreement for the JBCT program.

 

OTHER AGENCY INVOLVEMENT:

The Office of County Counsel has reviewed and advised on this Agreement as to legal form. The Auditor-Controller has reviewed and approved the Agreement as to fiscal provisions.

 

FINANCING:

The cost of this Amendment will be financed with revenues from the DSH contract.  There will be no increase in General Fund Contribution resulting from this action.
