a. Approve and authorize the Director of Health Services or designee to execute a standard agreement with the County of Monterey and Monterey County Children & Families Commission, publicly known as First 5 Monterey County for the provision of training for a total Agreement not to exceed $200,000 retroactive to July 15, 2024 through June 30, 2026; and;
b. Approve the modified Indemnification, modified Business Automobile Insurance provisions and the removal of Royalties and Inventions provision in the Agreement, as recommended by the Director of Health Services; and
c. Authorize the Director of Health Services or designee to approve up to three (3) future amendments that do not exceed 10% ($20,000) of the original Agreement amount, do not significantly alter the scope of services, and do not exceed the total not-to-exceed amount of $220,000.

RECOMMENDATION:
It is recommended that the Board of Supervisors:
a. Approve and authorize the Director of Health Services or designee to execute a standard agreement with the County of Monterey and Monterey County Children & Families Commission, publicly known as First 5 Monterey County for the provision of training for a total Agreement not to exceed $200,000 retroactive to July 15, 2024 through June 30, 2026; and;

SUMMARY/DISCUSSION:
First 5 Monterey County improves the lives of children, prenatal through age five, and their families by strengthening connections advancing quality within a whole system of care, support and training. Positive relationships are essential to the healthy development of a child. The purpose of this Agreement is to continue to bring Infant-Family Early Childhood Mental Health Trainings (IFECMH) to the community. This learning opportunity is designed to invite broad participation among the diverse workforce of Monterey County who serve children and their families. This training creates spaces for participants to reflect on and share experiences of working in their unique sociopolitical environments towards expanding their knowledge and awareness regarding their work with babies, young children, and their families.
The County of Monterey Health Department Behavioral Health Bureau wishes to provide funding for this vital training to continue and expand within the County. Due to delays in determining funding and negotiation of rates/scope of work, the Health Department was not able to process this agreement in a timely manner.
The Health Department requests that the Board of Supervisors accept and approve the removal of the Royalties and Inventions provision and accept and approve the Mutual Indemnification language.
This work supports the County of Monterey Health Department 2018-24 Strategic Plan Goal(s): 1. Empower the community to improve health; and 4. Engage MCHD workforce and improve operational functions to meet current and developing population health needs. It also supports the following of the ten essential public health services, specifically: 3. Inform, educate, and empower people about health issues; and 4. Mobilize community partnerships and action to identify and solve health problems.
OTHER AGENCY INVOLVEMENT:
County Counsel and the Auditor-Controller have reviewed and approved the Agreement as to legal form and fiscal provisions, respectively. However, Risk Management cannot accept the non-standard insurance modification.
FINANCING:
This Agreement is funded by Mental Health Services Act Workforce Education and Training revenues (100%), which are included in the Health Department’s Behavioral Health Bureau (HEA012, Unit 8410) FY 2024-25 Approved Budget. Any unused contract authority will be fully budgeted in the subsequent FYs, through the term of the Agreement.

Agreement
