a. Approve and authorize the Director of Health Services or designee to execute Amendment No. 1 to the Mental Health Services Agreement A-17250 with Promesa Behavioral Health for the provision of Short-term Residential Therapeutic Program (STRTP) treatment services including Case Management, Mental Health Services, Medication Support, and Crisis Intervention for children/youth, extending the term one fiscal year for a new term of September 3, 2024 to June 30, 2027 adding funds totaling $281,736 which represents an increase of $34,224 for FY 2024-2025, $112,708 for FY 2025-2026 and $134,804 for FY 2026-2027 for a revised total Agreement amount not to exceed $318,162; and
b. Approve and authorize the Director of Health Services or designee to execute up to three (3) future amendments that do not exceed 10% ($31,816) of the original Agreement amount, with a total not to exceed amount of $349,978 and that do not substantially change the scope of services.

RECOMMENDATION:
It is recommended that the County of Monterey Board of Supervisors:
a. Approve and authorize the Director of Health Services or designee to execute Amendment No. 1 to the Mental Health Services Agreement A-17250 with Promesa Behavioral Health for the provision of Short-term Residential Therapeutic Program (STRTP) treatment services including Case Management, Mental Health Services, Medication Support, and Crisis Intervention for children/youth, extending the term one fiscal year for a new term of September 3, 2024 to June 30, 2027 adding funds totaling $281,736 which represents an increase of $34,224 for FY 2024-2025, $112,708 for FY 2025-2026 and $134,804 for FY 2026-2027 for a revised total Agreement amount not to exceed $318,162; and

SUMMARY/DISCUSSION:
The County of Monterey currently has Agreement A-17250 with Promesa Behavioral Health to provide residential and specialty mental health services including specialized and intensive care, support, and 24-hour supervision on a short-term basis for children and youth with complex and severe needs. The goal of the program is to provide therapeutic interventions to treat and ameliorate the behavioral health symptoms and improve function so that children and adolescents may move to a less restrictive and intensive treatment setting.
Promesa Behavioral Health delivered more service units in Fiscal Year (FY) 2024-2025 than previously estimated. This proposed Amendment provides funds for the additional units served. This Amendment also adds funds to Fiscal Year (FY) 2025-2026 to provide Promesa Behavioral Health with an increased number of service units for them to serve four (4) Monterey County youth and extends the term of the agreement to June 30, 2027.
This Agreement contains the County’s standard 30-day “no cause” provision (Section V, B) and an additional defunding provision (Section V, D), which provides the County the ability to amend or terminate the Agreement in the event of a reduction and/or termination of funding.
This work supports one of the County of Monterey Health Department 2025-2028 Strategic Plan Goal(s): 2) Provide Exceptional Person-Centered Care through Accessible, Community-Focused Health Services. It also supports one of the ten essential public health services, specifically: (7) Link people to needed personal health services and assure the provision of health care when otherwise unavailable.
OTHER AGENCY INVOLVEMENT:
County Counsel and Auditor-Controller have reviewed and approved this Agreement as to legal form and fiscal provisions, respectively.
FINANCING:
This Agreement is funded by 2011 Realignment (50%) and Federal Financial Participation (50%). The funds for this Agreement are included in the Health Department’s Behavioral Health (HEA012, Unit 8410) Fiscal Year (FY) 2024-25 and Fiscal Year (FY) 2025-26 Adopted Budgets. The funds for FY2026-27 will be included in the Health Department’s Behavioral Health (HEA012, Unit 8410) Requested Budget.
