RECOMMENDATION:
It is recommended that the Board of Supervisors, as the code reviewing body, approve the newly established Conflict of Interest Code for the Monterey County Workforce Development Board
SUMMARY:
Following clarification of its status as a “legislative body” in a September Brown Act opinion from the Office of Legislative Counsel, the Monterey County Workforce Development Board has adopted a Conflict-of-Interest Code as required by Government Code section 87300. The Monterey County Workforce Development Board seeks Board approval of its newly established Conflict of Interest Code, which is attached hereto.
DISCUSSION:
Under Government Code section 87300, “[e]very agency shall adopt and promulgate a Conflict of Interest Code . . . .” The Monterey County Workforce Development Board recently received clarification in an advisory opinion of the Office of Legislative Counsel that it is considered a “legislative body” subject to the Brown Act, and concurrently, the Political Reform Act’s Conflict-of-Interest provisions. Consequently, it is required to adopt and promulgate its own Conflict of Interest Code.
Pursuant to sections 82011 and 87303 of the Government Code, the Board of Supervisors is the code reviewing body. It may approve the Code as submitted; revise the proposed code and approve it as revised; or return he proposed Code to the agency for revision and resubmission. The proposed Code, as established and submitted, is lawful under the Political Reform Act of 1974.
OTHER AGENCY INVOLVEMENT:
County Counsel recommends that the Board approve the newly established Conflict of Interest Code as submitted.
FINANCING:
there is no fiscal impact upon the County of Monterey resulting from the Board's approval of the newly established Conflict of Interest Code.
BOARD OF SUPERVISORS STRATEGIC INITIATIVES:
Approval of the established Conflict of Interest Code fulfills the Board's statutorily designated role as the code reviewing body pursuant to the Political Reform Act.
