a. Approve and authorize the Contracts/Purchasing Officer or Contracts/Purchasing Supervisor to execute Renewal and Amendment No. 1 between the County of Monterey, and Dave’s Repair Service to extend the term of existing services to provide on-call repair services and include new services described as annual underground storage tank monitor certification, spill bucket & LLD testing, annual underground tank vapor testing, monthly designated operator inspections and SP989 testing (Tri-Annual) at various County fueling sites in the amount of $111,580, for a total amount not to exceed $258,580 and extend the term retroactively from July 1, 2022 to June 30, 2024; and
b. Authorize the Contracts/ Purchasing Officer or Contracts/Purchasing Supervisor to execute Renewal and Amendment No. 1 to the Standard Agreement and up to two (2) additional years, subject to County Counsel approval, provided the terms of the Agreement remain substantially the same and provided the additional costs per year do not exceed ten percent (10%) of the cost of the prior year.

RECOMMENDATION:
It is recommended that the Board of Supervisors:
a. Approve and authorize the Contracts/Purchasing Officer or Contracts/Purchasing Supervisor to execute Renewal and Amendment No. 1 between the County of Monterey, and Dave’s Repair Service to extend the term of existing services to provide on-call repair services and include new services described as annual underground storage tank monitor certification, spill bucket & LLD testing, annual underground tank vapor testing, monthly designated operator inspections and SP989 testing (Tri-Annual) at various County fueling sites in the amount of $111,580, for a total amount not to exceed $258,580 and extend the term retroactively from July 1, 2022 to June 30, 2024; and

SUMMARY/DISCUSSION:
The Parties wish to extend the term of the renewed Agreement retroactively from July 1, 2022 through and including June 30, 2024 to allow Dave’s Repair Service to continue to provide on-call repair services and include new services described as annual underground storage tank monitor certification, spill bucket & LLD testing, annual underground tank vapor testing, monthly designated operator inspections and SP989 testing (Tri-Annual) at various County fueling sites identified in this agreement and as amended by this renewal and Amendment No. 1 will increase the Standard Agreement by $111,580, for a total amount not to exceed $258,580, and extends the term to June 30, 2024.
Dave’s Repair Service has continued to provide services to Fleet, and Fleet wishes to renew and amend the agreement via this renewal and amendment No. 1 to retroactively extend the term through June 30, 2024, in order to fill the gap between the current agreement that expired on June 30, 2022, and the Renewed Agreement beginning on July 1, 2022.
OTHER AGENCY INVOLVEMENT:
The Office of the County Counsel and the Auditor-Controller have reviewed and approved Amendment No. 1 as to form and fiscal provisions, respectively.
FINANCING:
There is no impact to the General Fund. Sufficient appropriations are available in the PWFP - Fleet (Fund 001, Department 3200, Unit 8577, Appropriations Unit PFP065) to finance Amendment No. 1.
BOARD OF SUPERVISORS STRATEGIC INITIATIVES:
The Board’s approval of the recommended agreement will allow the County to continue with testing for annual underground storage tank vapor testing, monthly designated operator inspections and SP989 testing (Tri-Annual) at various County fueling sites and Services to fit the County’s operational needs.
