a. Approve a Professional Services Agreement with ICF Jones & Stokes, Inc. where the Base Budget is $205,665 and the Contingency budget is $30,850, for a total amount not to exceed $236,515 to provide an Environmental Impact Report (EIR) for The Pebble Beach Company's Inclusionary Housing (PLN130447) in Pebble Beach, for a term of July 23, 2014 through June 30, 2016;
b. Approve a Funding Agreement with The Pebble Beach Company where the Base Budget is $205,665, the Contingency budget is $30,850, and the County contract administration fee is $3,170, for a total amount not to exceed $239,685 to allow funding to Monterey County for costs incurred by ICF Jones & Stokes, Inc. and County departments to provide an EIR for The Pebble Beach Company's Inclusionary Housing (PLN130447) in Pebble Beach, for a term of July 23, 2014 through June 30, 2016; and
c. Authorize the Director of Planning to execute the Professional Services Agreement, Funding Agreement and future amendments to the Agreements where the amendments do not significantly alter the scope of work or change the approved Agreement amounts.

RECOMMENDATION:
It is recommended that the Board of Supervisors:
a. Approve a Professional Services Agreement with ICF Jones & Stokes, Inc. where the Base Budget is $205,665 and the Contingency budget is $30,850, for a total amount not to exceed $236,515 to provide an Environmental Impact Report (EIR) for The Pebble Beach Company's Inclusionary Housing (PLN130447) in Pebble Beach, for a term of July 23, 2014 through June 30, 2016; and
b. SUMMARY/DISCUSSION:
This Professional Services Agreement (PSA) with ICF Jones & Stokes, Inc. and related Funding Agreement (FA) with The Pebble Beach Company will provide an EIR for The Pebble Beach Company's Inclusionary Housing located in Pebble Beach. The term of the PSA and FA is from July 23, 2014 through June 30, 2016.
The costs for this PSA are to be covered through the FA with The Pebble Beach Company, Project Applicant, and are related to the completion of The Pebble Beach Company's Inclusionary Housing EIR. The FA also covers the County's contract administration fee associated with processing of the PSA and FA.

The following offices have reviewed and approved the Agreements as to form and legality and fiscal provisions, respectively:

FINANCING:
There is no impact to the General Fund as a result of these actions. Pursuant to the terms of the FA with The Pebble Beach Company, Project Applicant, and the County, the expenses of ICF Jones & Stokes, Inc. to provide an EIR for The Pebble Beach Company's Inclusionary Housing and fees associated with County contract administration will be funded through budgets established in the FA. Separate fees for County staff costs associated with the Project will be paid by the Project Applicant in accordance with the County of Monterey Land Use Fee Schedule. There will be no impact to the General Fund.
