b. Approve nonstandard insurance provisions, as recommended by the Contracts/Purchasing Officer; and
c. Approve and authorize the Monterey County Laguna Seca Representative to execute up to three (3) future amendments to the nonstandard agreement where the total amendments do not exceed ten percent (10%), or $85,000, of the agreement amount and do not significantly change the scope of work, subject to County Counsel approval. RECOMMENDATION:
It is recommended that the Board of Supervisors:
a. Approve and authorize the Monterey County Laguna Seca Representative to execute a retroactive eighteen-month nonstandard agreement between American Medical Response and the County of Monterey for ambulance services at WeatherTech® Raceway at Laguna Seca with a term beginning July 1, 2021, through December 31, 2022, for an amount not to exceed $850,000;

c. SUMMARY/DISCUSSION:
This recommendation supports the retroactive use of American Medical Response (AMR) for ambulance medical standby services during track rentals and events at Monterey County Parks facility WeatherTech® Raceway at Laguna Seca. AMR provides advanced life support ambulances and crew. AMR staff provides first aid, emergency care, and, when necessary, medical transportation within the scope of their licensure. AMR is the County’s ambulance service provider, and provides unique, comprehensive services required for racetrack rentals and events.
The proposed retroactive nonstandard agreement (Attachment A) includes nonstandard insurance provisions in that the Commercial General Liability policy is written on a claims basis rather than the County’s standard of on an occurrence basis.
Staff requests the Board of Supervisors ratify the proposed retroactive nonstandard agreement and authorize the Monterey County Laguna Seca Representative to execute the nonstandard agreement and up to three (3) future amendments where the total amendments do not exceed ten percent (10%), or $85,000 of the Agreement amount and do not significantly change the scope of work. The delay in submitting the proposed Agreement was because A&D Consulting LLC (A&D) was under the assumption that a new County agreement for ambulance services was being finalized. A&D was not made aware that an amendment had been executed to extend the term of the current AMR County agreement established by Natividad.
OTHER AGENCY INVOLVEMENT:
The Office of County Counsel and Auditor-Controller’s Office reviewed and approved the proposed retroactive nonstandard agreement as to form and fiscal provisions, respectively. Risk Management reviewed and approved the nonstandard insurance provisions.
FINANCING:
The cost of the contracted services provided by AMR is not to exceed $850,000 for the duration of the Agreement. Fiscal Year 2021-22 Adopted Budget for Laguna Seca Recreation Area, Fund 453, Appropriation Unit CAO046, includes sufficient appropriations for this contract. Revenue from track rental events is expected to cover the majority of AMR’s costs, as they pass through to each track renter. There are a few County-sponsored events that the County is responsible for, and these costs are included in the Fiscal Year 2021-22 budget. Future costs for the remainder of this Agreement will be included in the respective fiscal year recommended budgets in Fund 453, Appropriation Unit PFP067.
BOARD OF SUPERVISORS STRATEGIC INITIATIVES:
The recommended action supports the Board of Supervisors Strategic Initiatives for Health & Human Services. Use of AMR’s services provides essential first aid, emergency care, and medical transportation for Facility users and the general public during track rentals and spectator events.
