RECOMMENDATION:
It is recommended that the Board of Supervisors:
 
a.   Accept the Conservation and Scenic Easement Deed and authorize the Chair to execute the Conservation and Scenic Easement Deed; and   
b.      Direct the Clerk of the Board to submit the Scenic Easement Deed to the County Recorder for filing.
 
SUMMARY/ DISCUSSION
On May 12, 2010, the Director of RMA - Planning approved the Latts Administrative Permit and Design Approval (County File No. PLN090437; Resolution No.10-016) to allow: a one-story 3,283 square foot, single family dwelling with an attached, 615 square foot, two-car garage; 650 square feet of covered patios; 360 linear feet of retaining wall; and grading (approximately 380 cubic yard of cut/ 380cubic yards of fill).  Condition 10 of Resolution No. 10-016 requires the applicant to record an Easement-Conservation and Scenic, and convey to the County of Monterey those portions over the northern and western portions of the property outside of the building envelope and paved areas where Toro Manzanita exists. The acceptance and recordation of the attached deed will satisfy Condition No. 10.
 
OTHER AGENCY INVOLVEMENT:
The Office of the County Counsel has approved the Conservation and Scenic Easement Deed as to form.
 
FINANCING:
Funding for staff time associated with this project is included in the FY13-14 Adopted Budget for RMA - Planning.
