RECOMMENDATION:

It is recommended that the Board of Supervisors:

a. Approve and authorize the County Purchasing Agent or designee to execute a Professional Services Agreement with Kimley-Horn and Associates, Inc., to continue to provide engineering services associated with the Countywide Fee Program Nexus Study; Agriculture and Winery Corridor Plan Impact; Carmel Valley Transportation Improvement Program Traffic Analysis and Fee Calculation, and California Environmental Quality Act Environmental Review for the term of July 1, 2026, through June 30, 2028, for a total amount not to exceed $371,708; and
b. Authorize the County Purchasing Agent or designee to execute up to two future amendments to the Agreement where the amendments do not significantly alter the scope of work and do not exceed 10% ($37,171) of the Agreement amount, subject to review by County Counsel.

 

SUMMARY:

The Housing and Community Development Department (HCD) previously entered into Professional Services Agreement A-12164 (Prior Agreement) with Kimley-Horn and Associates, Inc. (Kimley-Horn) on January 10, 2012, to provide engineering services associated with the Countywide Fee Program Nexus Study; Agriculture and Winery Corridor Plan Impact; Carmel Valley Transportation Improvement Program Traffic Analysis and Fee Calculation (CVTIP), and CEQA.  The new Professional Services Agreement (PSA) will allow HCD to continue these services with Kimley-Horn under the County’s current standard PSA provisions. 

 

DISCUSSION:

A new PSA is recommended to continue services previously authorized under the Prior Agreement, while updating contractual provisions to current County standards. Exhibit A to the new Agreement documents the Prior Agreement and the continuity of services. Exhibit B - Scope of Work/Payment Provisions incorporates all scopes of work from the Prior Agreement.

 

The Countywide Fee Program Nexus Study and the Carmel Valley Traffic Impact Fee Program have been completed.  The new PSA provides additional time for the Nexus Study Ordinance to be approved by the Board of Supervisors. 

 

OTHER AGENCY INVOLVEMENT:

The Offices of the County Counsel and Auditor-Controller have reviewed the PSA as to form and legality, and fiscal provisions, respectively.

 

FINANCING:

The cost of the proposed PSA and associated costs for staff time in managing the services are funded as part of the Fiscal Year 2026-27 adopted budget for the Public Works, Facilities and Parks - Road Fund (Fund 1201, Department 3200, Balance Sheet account 22910). Additional cost sharing may be coordinated with HCD based on the projects for which engineering services are provided.

 

BOARD OF SUPERVISORS STRATEGIC INITIATIVES

This action will assist the HCD and County’s efforts to complete one of the tasks for the 2010 General Plan Implementation and Priority Tasks which can contribute to a better quality of life in the community.
