Report

RECOMMENDATION:

It is recommended that the County of Monterey Board of Supervisors:

a. Approve and authorize the Director of Health Services or designee to execute a County Standard Agreement with Seneca Family of Agencies, retroactive to November 1, 2022, through June 30, 2026, to develop a Crisis Residential Treatment and Crisis Stabilization program, for a total Agreement amount not to exceed  $1,851,546; and

b. Authorize the Director of Health Services or designee to approve up to three (3) future amendments that do not exceed 10% ($185,154) of the original Agreement amount, do not significantly change the scope of services, and do not increase the total not to exceed amount over $2,036,701; and

c. Approve the non-standard cyber liability provisions in the Business Associate Agreement as recommended by the Director of Health Services.

SUMMARY/DISCUSSION:

The County of Monterey was awarded the California Health Facilities Financing Authority (“CHFFA”) Investment in Mental Health Wellness Grant Program for Children and Youth infrastructure funds to develop a Crisis Stabilization Unit and Crisis Residential Treatment program.  The County has partnered with Seneca Family of Agencies (“Seneca”) to use grant funds to renovate Seneca’s existing property to develop a Crisis Residential Treatment and Crisis Stabilization program. Development of a Crisis Residential Unit and Crisis Residential Treatment in Monterey County to serve children and youth suffering from severe mental illness will provide timely access to community-based intensive residential treatment and address the gap in service in the current behavioral health system of care.

This Agreement is being presented late to the Board due to CHFFA grant contracting requirements and negotiations of the cyber liability amount.  The CHFFA grant required execution of a lease agreement between Seneca and Monterey County to release grant funds to be used to pay Seneca’s renovation costs, a lengthy process that involved multiple levels of review by both parties.  This Agreement is being processed subsequent to the execution of the lease agreement, which occurred in September 2023.  Negotiations of cyber liability limits also resulted in delays in coming before the Board. Both parties have negotiated a reduced cyber liability insurance of $2,000,000 in the Exhibit E: Business Associate Agreement of the contract.  The Health Department requests that the Board accept the Director of Health Services’ recommendation to accept the modification to the cyber liability amount.

This work supports the Monterey County Health Department 2018-2024 Strategic Plan Goals: 3. Ensure access to culturally and linguistically appropriate, customer-friendly, quality health services.  It also supports one of the ten essential public health services, specifically: 7. Link people to needed personal health services and assure the provisions of health care when otherwise unavailable.

OTHER AGENCY INVOLVEMENT:

The Office of County Counsel and Auditor-Controller have reviewed and approved this Agreement as to legal form and fiscal provisions, respectively. Risk Management has not approved this Agreement due to non-standard cyber liability provisions.

FINANCING:

This Agreement is funded by CHFFA grant funds (100%).  The funds for this Agreement for FY 2022-23 and FY 2023-24 have been included in the Health Department’s Behavioral Health Bureau (HEA012, Unit 8410) FY 2022-23 and FY 2023-24 Adopted Budget.  Total expenditures for FY 2022-23 are $251,000. The funds for this Agreement for FY 2024-25 and FY 2025-26 will be included in the respective Health Department’s Behavioral health Bureau (HEA012, Unit 8410) FY 2024-25 and FY 2024-25 and FY 2025-26 Requested Budgets.
